Way to judge, Yorkshire Lady. You don't know the circumstances, maybe the holiday was paid for long ago, maybe it was to visit family and paid for by them, maybe it was to see a sick relative - or maybe just being human meant that the OP made an error of judgment themselves and went even though they perhaps should have used some money elsewhere - it's not for you or I to judge though is it?

I got in arrears with my counil tax (business premesis) which ended up with the bailifs. They turned up at my shop but guy was really nice and I agreed a payment plan with them and they sent me payment slips for the bank which was over a 12 week period. Have you phoned the bailifs office to ask for a repayment method

    Hi,

I phoned up the council and paid them the outstanding money direct.

I have refused to pay the bailiff's until they send me a letter breaking down all the charges they are trying to get me to pay... £150 of being a collection van.
I questioned how they could send a collection van when they had no authorised access to the house for collection. They said they never had to as there was a car on the drive they could collect...A car that was on HP? plus how on earth are they going to collect a car in a vauxhall astra van..
Yes, thats right. He turned up in a vauxhall astra van. Exactly the same size as they estate but with no windows at the back.

Had he turned up in a gert big hefty van or flat bed you could understand it.. But a astra van... What would they have sent round normally when they dont charge for a collection vehicle, prob the same damn astra van.
  • there is no point calling the police as they have no powers to stop a bailiff from doing his duties. He can't remove your car if you can prove it is on hp. however if he levied your car before he knew that it did not belong then the fees will stick as he can say that he had reason to believe the car belonged to you due to being parked on your drive. As for the £60per hour charging this can only be charged if you have made an arrangement to make a payment to the bailiff at a specific time but you have left him waiting for over an hour it is called a waiting fee. There is no harm whatsoever in going out to speak to him if you do take out the hp agreement on your car to show him then he should back down. Also contact your council to make sure that the removal fee he has charged you is correct as per agreed with them. A bailiff can charge 90-150 pounds for attending with the intention of removing and the amount will be agreed upon with the client (council) however a greedy bailiff will try and pull a fast one.

This "waiting time fee" CANNOT be charged. There is NO provision in the legal Statutory Fee Scale that permits bailiff companies to make this charge !!!

If you disagree......please provide details of the legal ruling !!!!
