    Thanks,

Is it not illegal for him to transfer money from my account even though he has the details?

We need more information to help you.

Did you set up a third party mandate?

Was the transaction done online? Or was it by some other method?

    Was the account ever joint?

How did he get your details to transfer money in the first place. Did you give them to him?

Did any transfers take place after you moved out with your permission?

I think you're wise to go to the police - this is appalling.
Just having someone's bank account name, sort code, account number etc doesn't mean a thing - anyone you have ever paid by cheque will have these details but it doesn't allow them to withdraw cash from your account.
Unless your ex has your card and pin, or you have given the bank your written authority to allow your ex to withdraw cash whenever he likes then both he and the bank could be held responsible.

I remember reading an article by Jeremy Clarkson at about the time when the government had lost (yet another) big bunch of our details. He ranted on about how it wasn't a big deal and in big capital letters at the top of his page he put his bank account number.

He went on to say which was his local branch, the street name and advised anyone to try to get money out.

A week or so later on his page he wrote another article about how someone had set up a £500 weekly direct debit to a charity and the bank had told him he had no hope of getting his money back as he had invited people to withdraw, however they were going to look into their procedures.

I'm sure someone on here will be able to find the article...

    To summarise.... tough luck

    Hi,
Can you please help me. I recently split up with my partner who i owned a house with. We split up and he bought me out of my share. I have just tried to use my bank card and it is declined. Have spoken to the bank and the account is under investigation. I have been told that he has withdrawn a substantial ammount of money (he has the bank details from when we were together). He has said that i gave him permission but i didnt and they say its my own fault for giving him the details? Surely that is theft and he cant get away with it. I am going to go to the police today and see what they can do? Please help?

over the counter...If you gave the bank permission for him to withdraw funds in writing at any point then they can still go ahead with the withdrawal if you have not advised them to cancel this authority.

If they went on his word alone then its the bank who have made an error and are responsible.

If it was online... then they will say its your fault for not changing passwords etc.

As previously mentioned, more information is needed to give you the right advice.

What a low life, I pray you get double the payback, and take him to the cleaners, the slimeball! Have you spoken to him about it, or hasnt he the courage to come clean?

    Hi,

Okay ill try and answer all these questions sorry for the delay. I have tried to speak to the bank over the phone and they are telling me nothing! They wont even say how much has been taked or by what means? I dont think they can do this as it is my account? They say the account is under investigation which i dont understand because it isnt me under investigation? He does not have a card or a pin, the details he had from the past were internet banking details . All the bank say is he has made two transactions of a "substantial amount" Can the bank withold info like this from me for starters? I have spoken with him and he said i did take the money and i will just say that you are lieing and gave me permission to take the money! What can i do. The account was never a joint account. I did not fill out a 3rd party mandate. I did give him the details but did not give him permission to withdraw money at this time or for a long time for that matter?

Id talk to him again asking how he could do this, and why, only be sure to record the conversation, and let him admit it again, youll have at the very least his admission. Use that against him.

You might not find this helpful, mikeluke, but why on earth didn't you change your internet banking security details when you split up?

If you are foolish enough to give these details to someone else - which breaches your bank's terms and conditions, in any case - you are doubly mad not to change them when you split up.

The bank hasn't done anything wrong. It has honoured instructions which, as far as its security systems are aware, were issued by you as the account holder.

Recovering the money is your problem, not theirs.

Am I right in assuming they have blocked you from access to this account while they are investigating?

The reason I ask is can you not check the online statement to see the transaction as this would tell you how the money was taken?

Or call the ex and ask him, how he took the money? He seems quite proud of his actions so will probably tell you.

Have spoken to him this morning and he has agreed to come into the branch on monday morn and admit to transfering it without permission and give me the money back. I think the bank will probably take further action against him if he admits this in front of them which should be fun. See how it goes!
