Please help money taken from my account

Hi,
Can you please help me. I recently split up with my partner who i owned a house with. We split up and he bought me out of my share. I have just tried to use my bank card and it is declined. Have spoken to the bank and the account is under investigation. I have been told that he has withdrawn a substantial ammount of money (he has the bank details from when we were together). He has said that i gave him permission but i didnt and they say its my own fault for giving him the details? Surely that is theft and he cant get away with it. I am going to go to the police today and see what they can do? Please help?

    Key point - is it a joint account? If so, then it is not theft.

    Just to check, even though i have given him permission in the past to withdraw money surely doesnt mean he can do it whenever he wants. Is it not illegal for him to use my bank even though i gave him the details. This will just end up his word against mine?

    Then it may be theft. However, the fact that you have given permission previously, may lead the bank to conclude that you have not taken reasonable precautions in keeping your details secure.

    There is a agreement called a 3rd party mandate! which allows him to access the account, sure you didn't set one of those up?

    I think you're wise to go to the police - this is appalling.
    Just having someone's bank account name, sort code, account number etc doesn't mean a thing - anyone you have ever paid by cheque will have these details but it doesn't allow them to withdraw cash from your account.
    Unless your ex has your card and pin, or you have given the bank your written authority to allow your ex to withdraw cash whenever he likes then both he and the bank could be held responsible.

    Is this via online banking ?

    If it is then, as mentioned previously, the bank may take the stance that it was against their policy for you to divulge your login / password.

    Additionally - it may be very hard to prove that you did not give permission considering that you have done so in the past.

    Did you give him your pin etc? Did you tell the bank or where they aware of you splitting up? What method did he use to take the money e.g. online,cash machine?
