PayPal not always on buyers side.

I am so angry and upset I am shaking. And yup, crying now.

I posted here before about a Lego set I bought on Ebay that was delivered 2/3rds incomplete. I have now been informed by PayPal that - "the claim does not fall under PayPal's definition of significantly not-as-described and does not qualify for a refund." That lost me £11, plus there was the fact I sent the set back to the seller twice via recorded (+£6) (first was refused). I have received numerous slanderous and abusive emails from the seller (informed ebay as he threatened to blacken my name on ebay forums). This morning another email, in which he thinks I got my refund -
"Just as I thought,not as much Lego has come back as was posted out and the instruction book is completely damaged.Nevermind you got your refund through Paypal......just never bid on anything else of mine you con merchant."
So more abuse.

He had admitted in previous emails "his daughter had said it was all there" and now he says I sent it back incomplete, which leads me to believe he never actually saw the set when he was selling it. And his daughter is protecting herself from angry daddy. It might have been her who refused it!

I am so upset, I thought PP would be on my side, now I am a liar who lost her fraudulent claim!

I don't suppose there is anything else I can do is there? I cannot believe I have lost £17 and that abusive seller is now happy!

Also might need your help on feedback - he has already left some (+ve), I need to word my neg correctly.

I feel so let down by the system...

    There is a time to lay things to rest and this looks like it. Start working on a decent (no emotional) negative feedback.

    Something along these lines (might be too long):-

    "Incomplete item, seller abusive & threatening, posted back seller refused to sign for."

    Thanks Hintza, just the calm reply I needed. Good idea for the feedback.

    It just seems things go against me when I try to fight my battles. From the tone in these forums PayPal always favour the buyer - I must've done something wrong, and I'm not going to forget in a hurry, but that's it really. I know I was conned and i bet even you're thinking something's fishy with my claims if I didn't win... It is now just the principle of the thing. Ho-hum.

    At least I've stopped shaking now.

    Claims for item not as described are notoriously difficult and as I said in that original thread it can go either way for buyer or seller. In fact where an item is sold as used it seems slightly more weighted in favour of seller, new, sealed items are weighted in favour of buyer.

    Hintza's feedback suggestion is excellent, as a buyer that would definitely make me think twice about the seller.

    I thought we had some suggestion now that using Taiwan might get the feedback withdrawn? Personally, since I wouldn't want to risk my neg being withdrawn for breaking rules, which none of us have found yet (!) I would stick with the UK site.

    Im sorry about all the hassle you have had, unfortunately by buying oe selling on ebay there is always risks involved.I too have lost about £10 through two purchases were the buyer never sent the item yet payapl could not get the money back. Personally I just move on (after some fantasies of how I am going to open 100 faulse accounts and ruin their auctions) and leave a very honest negative feedabck. I was naughty once and said " seller from hell would not recommend to my worst enemy.dishonest etc ".But generally I refrain from this - but occassionally it is theraputic. :D
    But maybe " item was incomplete.Unhelpfiul, refused refund + definately NOT recommended" .To be honest " not recommended " sems to pull a cord with a lot of ebayers.Good luck but try ( and its hard ) to do something nice and forget them - karma is a great thing.

    or Nasty Abusive Seller BEWARE

    Agutka, I expect this has been covered, but I've been back through the previous threads and couldn't see it: how did you fund the paypal payment? If it was by credit card, you have the option to try and start a chargeback through your credit card company. It may not get you anywhere but there's nothing to lose in phoning them up and asking.

    I have just realised something obvious - why would PayPal make me send the item back to the seller and then decide not to refund me? I have *just* realised I have no goods AND no money. That cannot be right. So I checked my emails and on friday (four days ago) PayPal wrote to me:

    "We have determined that you are due a refund on this PayPal
    transaction, including postage and packing, once the item, in its original
    condition, is returned to the seller."

    I sent it Friday, I know the seller received it (he reckons it's not all there - well hello? that's why I was complaining!) What happened in the meantime??
    I am confused...:confused:

    And btw I paid with a debit card.

    The problem with this sort of feedback is it could be just read as a bit of a rant. I think the more specific and factual you can be the better.
