I've just phoned PayPal and blokie said they will get back to me with which email was correct, as he was confused as to why they made me sent it back...

Agutka, its not your fault, PayPal don't always find in the case of the buyer even when they are correct. I just lost a claim for a car stereo that I bought because I couldn't get anyone to write an 'engineers report' for me to satisfy PayPal that the item was 'not as described'. Even if I had, i'm sure it would have cost me at least half of the amount of the refund that I was claiming, £52. So I now have a useless car stereo here thats cost me £52 which I will simply have to list on Ebay with a full and honest description and hope someone buys it and lessens my out-of-pocket expenses.
I've also just filed another chargeback for a stick of memory (£27.50) that was supplied as 'New' but which is faulty. No response from the seller to three emails over three weeks....here we go again....the only good thing was that he already left me feedback so I have neg'd him without having to worry about a retaliatory neg.

An engineers report? What kind of world do these people live in? Right, I'll just go round the corner shop and get one!
I thought having to fax them within 3 calendar days (or else) over the weekend was bad enough... like I have a fax at home.

PayPal are only on their 'own' side, they are not bothered about buyers or sellers, just their own bank accounts. They love disputes as they get to keep the money whilst the dispute rambles on, as they back debit the money from the sellers account immediately without even hearing the sellers side of the story. Normally for over 30 days. Imagine that for a 30 pound item several million times a year!! Nice interest earnings !! They are totally unregulated. Also everyone would do well to read the various anti PayPal sites on the web which can be found by typing anything like 'No PayPal' or 'anti PayPal' in Google, or look at paypalsucks.com. Beleive me, I am an ebay powerseller who won't use Paypal and even advertise anti Paypal banners on all my listings. Far better to support a UK company like Nochex0

It won't help with your Paypal claim but might make you feel a bit better to make a complaint to ebay about the sellers abusive emails to you!

Another update and yet more confusion.
I have been in contact with PayPal and apparently they have only sent the 'you're not due a refund' email as a default, because there is no confirmation the package has been received by the seller. Royal Mail cannot find proof of delivery ie cannot say on Track and Trace that the package was delivered OR give me a copy of the signature. I have received a letter from them apologising for the inconvenience with a book of 6 free stamps as a gesture of goodwill! And an email saying the package had been classed as 'lost' and how I should go about getting a refund off them!
Therefore:- I can claim my money theoretically off Royal Mail
- PayPal I believe still hold the funds they took off the seller in order to refund me - but will not pay up as there is not enough proof the package was delivered - can they keep the money?
- Is it possible in this situation to get a refund off Royal Mail AND PayPal?
Oh and the PO says they might refund me the postage...????
Last resort is getting PayPal to talk to the seller - he has the package - he knows nothing of these delays as I have had no gloating emails off him.:wall:0 -
It looks to me like you could end up with 2 refunds, 1 refund or no refunds depending on whether how long RM take to decide whether your item was lost. I feel for you - it's an awful situation. If RM finally show it up as delivered after paypal have sided with the seller, then contact your debit card issuer and see if you can persue a refund through them.0

Just reading all this is enough to stop me buying on ebay ever again. I've bought about 20 items and had 2 disapointments. What gets me is you do everything you can (email and question the seller, check their feedback, research your item carefully) to avoid problems and you get sent items that have faults, stains on shirts, chips in golf clubs, 2 pieces missing out of jigsaws. I know ebay is built on trust and as a buyer I take risks, but its when a seller either doesn't check the item before they sell it, or worse lie just to make a sale, you have to ask is it worth the risk?

Okay, seems to me PayPal have given up on this case and have refunded the seller MY MONEY.:mad:
I can get the money back off Royal Mail, so that's not a problem.
BUT I have a HUGE problem with that seller getting to keep the money and the lego item.
So, is there anything I can do? If it was any larger amount of money then small claims or police or rabid dogs, but we're talking about £11 here. Which I really don't want him to have. I have an item not received, nps situation here, but Ebay said something about not being able to help as I had started a PayPal chargeback - is this true?
