Problem seller - getting silly now...

Need more support and advice!

Following on from my earlier post:

http://forums.moneysavingexpert.com/showthread.html?t=88816&page=1&pp=10
(is that a link?)

In short - bought lego, received incomplete, asked seller for refund, sent item back recorded delivery. After a week of no reply started PayPal chargeback. Package came back to me 'refused'. Seller angry I am trying to get refund without returning the item.

The seller refuses to believe I ever sent the lego back, even though I have even sent him detailed photographs of the Royal Mail stickers etc. I have now received lot of "I will report this matter to the authorities as that is theft" emails. He's called me a thief a few times but today's email takes the biscuit:

QUOTE I'v never encounted this sort of problem on ebay before and have come to the conclusion that you are either stupid or a con artist who is trying to get a set of Lego for free by keeping it and applying for a refund via
Paypal......all this seems very strange to me as you have been difficult
from the outsetand I will be updating my feedback left for you
accordingly and posting this whole matter on the Ebay message boards to warn other sellers. UNQUOTE

That is just mean...

Would he be allowed to do such a thing on the message boards?

I have a feeling that I will have to start up on ebay a-new, just to hide from this guy.
I have not been difficult, only honest, polite and understanding. Only to receive varied threats from someone who has NOT ONCE started an email with a 'dear' or 'hi' or ended with signing his name!

Thank you for your support to date guys.

The parcel was returned to me with a PO sticker on it and refused ticked as reason for non-delivery. I sent the seller photos of that sticker.

Remembering back to the original thread the seller refused to sign for the RD parcel so the Lego was sent back to the buyer.

The one interesting thing that has been said though is that the seller has threatened to discuss this on the ebay boards. I don't read them very much at all but it might be worth someone watching the boards to see if he does, and if so assuming he gives any details of the buyer ebay will be interested. It is against ebay terms and conditions to malign (can't think of actual wording) or publicly place details of another user in an open forum, which is why we Board guides often remove identifying information from posts on here. If you see anything, turn him in immediately.

Likewise, send his latest email to ebay, as it might be considered a 'threat' and be enough to get a warning on his account.

Thank you, I was hoping he wouldn't be allowed to use the boards for that kind of thing. I am now starting to feel he is using all his threat ideas on me.

And cookiemonster, he has already left +ve feedback. I haven't.

How does one contact ebay? I haven't talked to them yet, as they only turn you over to PayPal. But this threat business is another ball game...

    Thanks again guys.

To contact eBay, you generally have to use this email form. For your situation, I'd suggest Report problems with other eBay members -> Problems with sellers -> You paid, but the item wasn't as described.

I don't think there is any chance that this person is going to redeem themselves now, so I really think you should leave feedback to warn other users of your problems. As for reporting them to ebay, I think you should do as spinner says, but to avoid being referred to paypal, I would go for problems with other eBay members -> Problems with sellers -> The problem you are having isn't listed. Then you can deal with the issue of the threats as well as pointing out how you got to that situation.
