Just to keep everyone posted, we have heard back from our solicitor. She has confirmed that the "no bbq" clause is not explicitly stated in the lease agreement and although the management company has a right to add new rules when they like, they have to do this by writing to us and informing us about the new rule as stated in a clause in the lease agreement. As such, OH and I feel that since we didn't received written notification from the management company, we can technically take it that this rule is "invalid".
BUT as we don't cause huge problems with our neighbours so what we intend to do is to have the bbq still on and to ask our next door neighbour if it is ok (but doubt he would have a problem since he has his own pit :rotfl: ). Also, we intend to compromise on the outside cooking and to do half the cooking indoors so as to minimise the time we are using the pit.
We will only do this as a one-off for the housewarming party this week as it is really too late to cancel when everyone is looking forward to it and then we intend to take it up further with the management company and asking the opinion from the rest of the residents and maybe set up a resident association as kittie has suggested. Sounds reasonable?
P/S: OH noticed that the no bbq rule was due to fire and health and safety. Does it mean that if we have an ELECTRIC bbq, i.e. no fire, we are allowed to have a bbq??? :rotfl:0 -
want2befree don`t mix up the management company with any residents association. The management company can and will, take decisions without any residents input. I would talk to residents about any residents association that might be in existence. Perhaps in future, start one like my dh did. You can get so much more done as a group
Will definitely think about your suggestion as we are thinking of getting a group of residents together to speak to the management company re the no bbq rule.
If you are referring to my comment about having a share in the management company, we are shareholders in the management company (how, I have no idea) so maybe this will work to our advantage coz even if the management company can add new rules, as shareholders, do we have some sort of right?0 -
my partner and i felt forced to mobe out of the flat we were renting based on the fact the LL did not read the terms of his lease as set out by the managemnet company regarding the keeping of cats they gave us a set amount of time to remove the cat. so we had to move also
