An insurance company that doesnt want to to pay up

    i don't think there is, but why would there be?

    can hits wall and surely the impact would force the can away from the wall and down. gloss is quite a thick liquid and wouldn't "splatter" like an emulsion paint. I don't see it as a relevant question and having/heard the questions asked I don't think the insurance comapny do either.

    I asked you 2 pages ago if there was any photos of the damaged rug or damaged laminate they decided not to claim for.

    The reply was:

    A little on the floor which came up quite easily (laminated floor).. a little on a cheap rug which was bought from next, but they decided to chuck the rug as it wasn't worth the hassle on the day... and some on the kids clothes... that clear things up?!

    Which if the OP friends' didn't explain in their insurance claim make them look even more dodgy. If they kept at least the kid's clothes and the rug then not having photos of the laminate wouldn't be so much of a problem.

    The statement from the paint can design guy is useless and irrelevant as the friends' are claiming the paint can wasn't opened. If they stated the can was opened and resealed then his statement would be very useful.

    @Superdad - no one is accusing your friends' of being liars they are simply stating from the facts on the balance of probabilities it looks like the claim is an attempt to defraud the insurance company. If your friends' choose to pursue the claim to the courts or the Financial Ombudsman Service they will rule the case on the balance of probabilities as well. And if there is not sufficient evidence to back up the claim the insurance company will not pay out.
    I'm not cynical I'm realistic :p

    yes, pictures are available .
    claim was that they never opened it... however they could not say whether it had been opened in-store by someone else.

    I presume they took photos directly after it happened, which will help with the insurance to decide if it's staged or genuine? It's generally the first thing people do when these things happen!! Did they try and clean it up and take photos of the cleaning efforts too???

    The bit that the insurance will find hard to believe is the fact it's a 2 year old. How heavy was the paint can? I believe a 2 (almost 3) year old can throw it, but how many would actually be able to throw it above sofa height against a wall, with enough force for it to open, then drop down and spill onto the sofa? Don't forget he would no doubt be standing behind the sofa, so that's quite a projectile for a little'un!!

    In a previous job I've done testing of other types of can (oil etc...), hence I know where the insurance company might be coming from...

    The other query is leaving a child so young on their own with a can of paint in the room (why??????), without even checking that the lid was firmly closed, or moving it out of the child's reach. The insurance might argue that it's blatant negligence on your friend's behalf, rather than accidental.

    No, photo's were taken the day after, after they'd tried cleaning it up. I don't think their first thought was to claim.

    The sofas are quite low backed (in fact very low) for instance, i'm about 6ft and if i stood against the sofa it would come in between my knee and hip... up to around the child's upper chest area.

    paint was only a small (ish) can... 750ml.. (is that around the same amount of liquid as 2 cans of coke?... hmmmm... i should weigh a full can of paint)

    the sofa has its back against a wall.. he would have been stood in front of it... it's the only way he could have done it.

    with regards leaving him alone... they'd just been shopping and dropped some of the bags in the living room and taken the food bags to the kitchen to put away... anything non-food was in the living room with darling child.

    Sometimes the truth is stranger than fiction. A similar thing happened to my friends carpet (Irn Bru stain) the ins co would not believe it was accidental. They paid up but she struggled to get house insurance after they cancelled the policy.
