Restrictive covenants enforceable?
Hi all, I've been reading up on the enforceability of restrictive covenants and have been pretty overwhelmed with the comexity of all of this. If I, along with all my immediate neighbours, own the freehold on their property, does this mean RC's aren't enforceable with regards to building an extension/conservatory as the…

Sale below valuation - legal/tax implications
Good afternoon. My first post in this forum, a quick question on valuations vs price: In a private market sale of a residential property I own in
England, am I allowed to agree with a third party buyer (i.e. no family
member etc.) a price below valuation or are there legal limitations as to the
price that can be agreed,…

If she buys a brand new house with her inheritance free and clear, no mortgage, let's her boyfriend live in, he pays towards expenses, they decide to split, as he got any entitlement to the house? I didn't think so but I guess he at least has rights as a resident

Builder recommended by agent?
I've spoken to the sellers agent about the survey- report says a lot of work needed. They've has sent details of a local builder who might be able to visit/quote. The agent works for the seller, so how much would you trust what this builder says about costs. Or am I being paranoid? Any thoughts/ ways to approach?

Inflated valuation, property needs work - what to offer?
Hi all We finally found a house we like that has enough rooms for us and four kids. The HR (Scotland) values it's at 270k but acknowledges that the valuation is based on an unusual market situation. It's advertised as a 7 bed (2 are tiny rooms, passable as a study) and on for offers over 250k. It's currently advertised as…

Sellers solicitor refusing to answer enquiries
We are (hopefully) close to being in a position to exchange contracts, but have run into a seemingly unresolvable problem. The sellers solicitor, despite having gained the relevant information from the seller, has flat out refused to answer the legal enquiries that our lender needs answers to before we can proceed any…

Spotlights in 2007 extension
I've just bought a bungalow and the extension has 11 spotlights. One of them went recently and wouldn't work when I replaced the bulb, so I rang the electrician. He's just been and said they'll all have to be replaced as the halogen bulbs will no longer be available, I'll have to change to LED fittings. There are six in…

Amending mortgage after survey
We have just re-negotiated the price of our purchase based on the survey findings, and need to amend our mortgage amount with NatWest. Does this take long? Is it complex? We are looking to complete by 30th September for the SDLT holiday deadline, but have been told our vendor is away for 3 weeks from 22nd September. He is…

First time seller
Hello, We are first-time sellers. The plan is to sell our home in Cheshire and move into rental in Brighton. We are moving to Brighton and think we need to be in the area for a bit before we purchase a property there so need to rent first (approx 6 months - may use long-term airbnb). We will then get a feel for areas where…

Section 20 Notice - Completely Unnecessary Work
We received a notice of section 20 major works to our block of flats a few months ago. We are a leaseholder and the freehold is managed by a managing agent. We have now received details of the works to be done and the costs involved. Bare in mind that the building was only built 4 years ago. We have been asked to pay just…

Selling when gifted money towards property
Hi, my husband and I bought a property from my husbands parents at the beginning of the year in Scotland. It was valued at £300000. Our mortgage is for £255000 and in both our names. We paid a £5000 deposit, and the difference in value and cost of the property is what the mortgage is against. Unfortunately my husband’s…

Indemnity Insurance for Build Over Sewer
We are selling our house and it turns out that the previous owners build a conservatory over a sewer which was not picked up by our surveyor or solicitor at time of purchase. Who completes the compliance certificate for a restriction for the Land Registry?
The solicitors are in a ping/pong. The restriction is in relation to the annual management fee (third party). The pack states that either the buyer or seller's conveyancer can complete it but my conveyancer says that as the buyers have to agree and sign the deed, it is their role. They say it is the seller's role. I'm so…

Just had enough
I don't know where to begin. I was supposed to exchange contracts and set a completion date today (which was agreed- or so I assumed- for Friday). This could have happened last week- but my selling conveyancers said that ex-wife had not agreed to exchange (she did, she copied me into the email). My ex-wife an I are on the…
