    I don't think is going anywhere near a courtroom. VCS will not expose its airport operations to a Judge lest they lose and precipitate the tumbling of their house of cards. So have any 'fun' with the IAS, because I suspect that's as far as this will get.

    They've managed to cite a totally unrelated case before (something about someone forensically linked to a hit and run who stated he was the only one with keys, the car was in his possession, but he wasn't the driver) to try and claim that on the balance of probabilities, the keeper is still the driver despite the keepers claims otherwise. Very much calling the keeper a liar.

    But it's total crap; it's intended purely to scare the layman into paying up since there's case law which apparently backs up the "independent" adjudicator.
  • received standard vcs appeal rejection letter today. let the fun begin....
  • vcs have made no effort to acknowledge my request for a vat receipt so I have reported them to hmrc for suspicion of tax evasion.

    now that I've received my appeal rejection from vcs, i'm still undecided whether to appeal to the ias or not. in the rejection letter vcs have mentioned the beavis case. does anybody think it is likely that we will get the beavis case verdict within the next 20 days or so?

    The Beavis case is not in any way related to your case .....

    over staying free period v stopping.

    The IAS appeal is all most irrelevant too ...

    You will loose what ever you appeal with (unless you win the daily IAS lottery >20% chance)

    Appealing is some thing you do just to see what ever excuse they can come up with

    VCS have yet to take a single airport case to a real court !

  • thanks ralph, i'm going to send a short and sweet appeal in to the ias just so vcs will have to spend £20 and so we can have a laugh at the rejection letter.

    Also, despite the comments I too went to IAS, and I think it was the right decision - it just adds to the bull that VCS won't want to see put in front of a judge.

    It will also make them look pretty unreasonable when it comes to you claiming your costs in defending something that should never have happened (the more unreasonably they look, the better your chances of being awarded costs).
