Where do I stand legally with refusing to pay my contract bill?
Orange have overcharged me for the 3rd month running (I've only been a customer for 3 months!!!!!!!). I have unlimited txt messages but have only been allowed 500 on my account so have been charged for the remaining. I have gone into the shop, and phoned customer services 3 times. Each time they say something will get done about it but nothing has. I feel the only way to actually do something is to take action like this. Being that i've overpaid nearly £50 technically I dont owe them anything.
I dont know any other route. I'm writing them a letter of complaing to head office outlining all my over charges but need some legal gumph to back it up. Should I ask for compensation of some kind?

explain fully and politely, and you may even get compensation for the inconvience - i got 1 months free line rental for a billing issue from customer care, granted it took more than a few attempts like yourself to get it sorted!
hint: the same email should be sent at the same time to customer.services@orange.co.uk this allows the exec office to know you have followed protocol via customer services once again and if you have not had it sorted by the time they get to your email they will be asking customer care " why not ? ", it also will be noted by the person recieving the email @ customer care you are not happy and have sent it to the executive office aswellSO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... You will be leaving the UK aswell as Europe0 -
Juts contact them and tell them that they have been responsible for a fundamental breach of the terms of the contract and that you want them to sort it now and also compensate you for their breaches. See what they say to that.0

agree with all the above but please think carefully about withholding payment.
It can show up on your credit file and could cause other problems, instead make a part payment and explain in your email?0 -

hmm true.. hopefully it should be sorted in 2 weeks. (otherwise i'll have to cancel the direct debit and pay manually!)0 -

I feel your anger to my friend.
6 Months ago i signed up to one of their animal deals, Racoon £35 per month.
How ever I hav not had a £35 bill yet. What they dont tell you in there adverts or (that I can find) in their terms and conditions is that VAT is added onto you bill thus you'll never have a £35 bill.
Now i contacted customer service via 150 only to be told by some snotty wee !!!!, that everyone in this counrty pays VAT, i agree but surely they should have it in their ads or T&C saying that the £35 excludes vat.
Anyone else noticed this, shud i maybe take this matter up via the email addi's above???:T :T Premium Bond Saver :T :T

my dolphin always been £35 ???SO... now England its the Scots turn to say dont leave the UK, stay in Europe with us in the UK, dont let the tories fool you like they did us with empty lies... You will be leaving the UK aswell as Europe0

mine shows up at the top as £29 odd for the Dolphin £35 and then VAT is added on below so in total it should be £35. Are you paying for anything else like the weekend and evening WAP? or delivery reports?0

my suggestion would have been what your doing writing to head office dont thinnk need anything else but the law of contract,
you signed up for unlimited text and in breach of your contract you are being over charged so give them what 30days to either resolve the issue and pay for any extra charges you have incurred when you shouldnt have or to issue you with a pac code and you will take legal action to get back your moneyYes Your Dukeiness0
