Thanks very much for your help. Do you think its possible to try and bargain with the bank, and say as you can't produce the loan agreement remove the rest of the PPI and we will not take things any further? or would we just sound stupid!
Yes...I would think you have a complaint here.;)

Hell no go for it, without the legal document the charge still stands as you have benefited from the funds. HOWEVER the finer points can not be challenged by them i.e ppi inclusion etc.

In this instance its up to them to prove YOU wrong not the other way around, not easy to do without a credit agreement. Court would be unlikely as their sols would more than likely concede as a judge would laugh them out of the chambers!

So what are you saying on this then?? I am confused here... are you saying the poster has no chance or the other way around:confused: .

Are you saying to challenge the PPI being part of the agreement??

This is becoming tiresome explaing things to you marshallka, please let it drop.

MY POST CLEARLYT STATES THAT THE LENDER WOULD NOT GO TO COURT AS THEY HAVE NO LEGAL CHARGE, THIS WOULD SURLEY MEAN THAT THE POSTER HAS A GREAT CASE.

Think before you type, it really does help.

God you are really getting to me now. I was trying to be nice in that post ....I was wondering what you were saying about "hell no!!". You challenged my post and I ASKED what you were stating. That is all.

I think I will call it a night tonight as I have had enough of your comments and never in all this time on this thread have I ever had words with anyone. Please don't take your problems out on me.

I have ALWAYS tried to help people on here...

Good luck then and let us know...;) .

Got home tonight- had a letter from Egg:

'Thanks for your letter, blah blah blah, After carrying out a review I have arranged for a full refund of all card repayment protection charged to your account, together with associated interest.'

    Total amount is £1364!!!!!!!!!!! (6.66% interest) :j

They also refunded £1529 in June as their PPI isn't functional in defaults (i'm in a CCCS plan)!

Brilliant, just Lloyds to sort out now.....!!
