Thanks i sent the complaint in Sept/Oct 2007 so that would be about June/July this year its nice that they send you monthly letters to let you know your in the system but it would be better if they just sorted it out one way or another. If the ombudsman upholds my claim do MBNA have to pay up there and then or can they string that out for a while too?
    hi,
if ombudsman uphold claim they will order mbna to pay redress
within 28 days. If they still fail to pay then FOS will refer your complaint to
FSA.Hope this is some help. Got information from adjudicator as in same position with firstplus

Why are ringing? Why not just do a template letter and add your reasons. This needs to be in writing really as there is always proof this way and send it recorded delivery too. You then have a receipt and proof of posting and they have to respond to you within a time limit.

I don't know how they dare when the the FOS has told them. They make me so angry and its not even my cheque. They have 28 days don't they? I bet they will hold out until the last day of the 28 days. Just to let every one know they are still holding the reins.

    Hi,
no we are still waiting for ombudsman to issue final decision.
Hope it is in our favour as FP are playing hardball.Don,t no how
long that will take.28 days to pay applies to ombudsman making
final decision on case not sure how long they have to payup if agree
to case being upheld sorry. Wouldn,t give them to long though as its your
money and if the ball was on other foot they would be quick enough at
referring you to debt collections to pay up.

Just had a reply to my sending details of Freedom/Firstplus/Bespoke to the OFT. I did know that they could not help but wanted them to know certain things and got this reply today.

Unfortunately, the Office of Fair Trading is unable to help you on this occasion as we do not have the powers to assist or advise individual consumers. Nor can we normally comment or take action on cases brought to us by individual consumers. Our primary duties include the enforcement of Competition Law, the regulation of the consumer credit market through a licensing system and the application of consumer protection legislation in respect of matters that adversely affect the collective interests of consumers.

The OFT can also investigate markets that do not appear to be working well for consumers and complaints or information received may be forwarded to one of our investigation teams for their further consideration. Your complaint has therefore been registered on our database and the information contained within may be referred to if the OFT decides to investigate this market in the future.

At least its been registered. It may help future victims.

What happens if you cancel your ppi that was added onto your loan amount before settling a loan. I wrote earlier of a calculation that i would of been £2420 better off just by doing this but was i right in that then the settlement figure is calculated on just the actual loan and not the loan and the ppi or with this front loaded policy that i had you bombarded on me i actually owe it choose what and it is part of the loan. I am so confused here. If the latter is the case then when i requested to cancel it it did not matter at all as they would of only given me £90 back and still done my settlement on the whole amount the same as just paying it all up the same day.

I seem to remember asking about cancelling the ppi to reduce the payments and they said i would not be able to do that as it would mean a new loan. I can't be sure but i think that is what they said to me. Would they have been correct? Is that what front loaded policies are like.

Can someone with a better understanding please confirm this to me.

God the more i think about these policies the more angry i get. What rip offs.
