well luvagoose - i really do hope you win this as MBNA are my worst nightmare and if i win the lotto ill pay your costs! really
my sis had her card cloned she is with lloyds, but the money was a atm transaction in canada and she was able to prove that she had used her card in the uka few hours earllier in the day so i guess lloyds had hard evidence as such,
could it be possible to help you im thinking, that at the time of the dsputed transactions taking place you perhaps bought something with your card? or someone can verify they saw your card in your possession.
i know its a bit of a long shot but anything as evidence will help wont it
anyway good luck, ive told MBNA they are my worst nightmare, and im serious, the quicker i get rid of them from my life the better i will feel.
no compassion, no understanding and they send letters supposedly signed by their Vice President, am i supposed to be impressed by that?? just try and have a bit of empathy with your customers is what im going to write in my next letter to them!!

understand where you are coming from, but MBNA have already implied (in a round about way) that everyone that visits me (or hubby) are potential thieves and could have taken the card without our knowledge, used it and then put it back again.
and from what we have learnt from this forum MBNA are arrogant/useless in helping in any situation, apart from when they have your debit card number to pay them, then they spring into action like a coiled spring and debit your account as quick as a flash.0 -
I have to say that your draft letter is brilliant! I suspect a lot of these events are inside jobs. If this is a brand new account, did you get any Additional User cards? I could see that leading to the apparent use of a ‘genuine’ chip.
I have every sympathy. Years ago we found MBNA to be cheating on their ‘Late Payment’ debits. There was no way our payments on the CC were getting there late, but pretty much every second month or so there was another hit for £15 or whatever. We dumped them immediately, and now if I see the letters MBNA or their Chester address anywhere on a document it goes straight in the recycling bin.

the account is over a year old and hubby is the only one with a MBNA card in this household .
we are now suspecting that the transactions that hubby made through a terminal (not ATM) was possibly a tester for the terminal to see if the added components to the terminal could read a chip(possibly), as it now has come out in the news that crooks have been caught with chip cloning equipment (Birmingham) which is not a million miles away from me.
they took £1700.00 from the account in 4 separate transactions and if it was a tester for the equipment and it succeeded did the cloned card end up in the hands of the Birmingham police?(was it them???), the bank have stopped the card, but if the crooks tried again to remove money from a bank account and found that it wasn't working then they would move onto the next card clone.
these people were unfortunate to have got caught (unfortunate for them), how many other crooks are out there perfecting the art of chip cloning, i don't think it will be long now before a bank will be rinsed to the max by a crook that has cloned the chip0 -

My point about the Additional User card was that maybe one was generated but didn’t get to you it went somewhere else. However all the recent news about successful chip clones has to make it more likely that cases like yours can be fought and won.
I don’t understand what you mean by terminal as opposed to atm? Do you mean a retailer’s desk top machine? If so, then I understand the rest of the post.0 -
I don't want to comment on the details of your dispute, but if you want honest feedback about your draft letter, this is my opinion -
I think it starts off very well - really clear and to the point. But about half way through it turns into a long inarticulate ramble. Get rid of all the exclamation marks!!!!!!! And all the angry indignation - I understand how you feel, but this will not help your case. It just makes you sound out of control.
There is a web site out there with lots of info about the flaws in chip & pin's supposedly perfect security (I think it is called Chip & Spin). Might find some useful info there.

Have to say i agree with you. Personally i don't think putting examples of thier corrupt staff members in the letter is a very wise move, it has nothing to do with your personal case and could be seen as a personal attack.
All you want at the end of the day is the situation resolved - be very careful what you write about other people because wether it's true of not it could very easily be used against you - think 'libel'.0
