    hi all,
not been on for a while been busy, this is a list of crap had of blackhorse.
47 days from first letter sent asking for all documents of accounts held past & present.
    16th oct 1st letter sent.
22nd oct recieved reply denying any mis-selling,no mention of documents.
24th oct sent letter not happy with decison, asked again about documents.no reply.
12th nov sent letter of disappointment over no response to previous letters & no documents being sent.
12th nov also sent SAR to local branch trying to get all documentation held, £10 cheque enclosed.
17th nov recieved phone call from blackhorse local branch, lady named derris saying they had not recieved 1st letter requesting documents, & the proof of delivery signature was none of there employee's. she was ringing about SAR & there was no charge for this request & would send our cheque back. i questioned this,to be told all documents would be with me with in 14 days.
21st nov recieved a response letter to the letter sent 24 oct in absence of any evidence in support of the claim, their decision remains unchanged.FINAL RESPONSE. no mention of any documents.
27TH nov sent letter of disapointment of blackhorse, how could they give a final response, when no documentation had been recieved or ever mentioned.
2nd dec i phoned local branch asking for derris, was told she was only there a few days & had done nothing, i didn't believe a word of it previous conversation with her was not like somebody there for a few days. i asked for documentation held, there reply we cant do anything litigation have your records, i said all documentation before existing loans had nothing to do with litigation & your breaking the law, didn't answer this, he said i will put you through to liigation. i was transferred & cut off.
i phoned complaints had a go, to be told i had not sent request to right office, i asked why my requests had not been past on internally, & told we dont do that, asked why this information was being withheld for 47 days no reply.
    COMPLIANCE ADMINISTRATION DEP
    BLACKHORSE LTD
    HOLBROOK HOUSE
    116 COCKFOSTERS ROAD
    BARNET
    EN4 0DY
I have had the total run around of this company, not once was this address mentioed in reply or phone conversation.
    sent complaint to ICO/FLA/FSA
was in court yesterday over being behind on payments to existing loan with blackhorse, they didnt even turn up it was ajourned, the judge was peed off & said they can apply no more charges to my account.
spoke to citizens advice, she told me they were flooded with complaints about blackhorse, & to make an appiontment with here to sort out all my problems.
im not giving up its fired me up, so if anyone new thinks it can be easy going thats not always the case, so don't be put off.

    Hi Masmit

What a total joke Black Horse are. Good luck with this, am glad you are pursuing them. They seem to have kept that address very quiet, I have been sending mine to Cardiff, no wonder I've had no response! Keep us posted!

Yeah, sounds like Firstplus all over. Just to double check here, you did not use a broker at all for this did you???

Just take a look at the link here and see what you can add and delete from the template letter. Its always best to do your own from this. There are lots of reason on there for the misselling so pick out the ones that are applicable to yours.

You then write to the firm that actually made the sale of the PPI to you if this is different from the lender and don't forget to send this recorded delivery so you always a proof and dates etc.

After that you have to give them 8 weeks for a full and final response. In this time it is usual to get a response of "sorry we sold this to you fairly" but you then respond to this and reiterate your complaint again. The next time they write they either give you a final response which you would need in order to take this complaint to the FOS or offer to settle.

    Good luck

No there was no broker involved. I only spoke to first plus. Have looked at the template letter & have a complaints address at first plus to send too so will get it up & running. Only thing is that my new mortgage will be through before the 8 weeks are up & the loan will need to be payed off. I suppose this is unavoidable & will have to be done.

    Thanks for the help :T

I cannot understand how your husband deleted the payment mandate to Welcome in the first place...

Normally you would have telephone or write to the bank to do this??

Also I take it you have not made any repayments for some time??

COuld you not have sent some payments to them recorded delivery in the form of cheques or even a direct payment from your bank?

This one is a difficult one as you need proof of all these things here. Do you have any kind of proof of trying to contact them at all.

The PPI seems to have been missold but seems like a difficult one here. You could always try!!

    Hi

    Thank you for the reply,

I honestly dont know how he managed to delete the direct debits but he must have done as the bank said they didnt and welcome said they didnt, and it just so happens they are canceled the same day as my hubby signs up for Internet banking although he denies it - its to much of a coincidence i think!!!!

We have made a few payments between then and now, normally this has resulted from us phoning the branch and offering payment £100 here £200 there, but no regular payments have been made.

I dont have any documented proof that we have tried to contact them but everytime we have made contact I have asked them to put a note on the computer saying that we had called the office to try and sort this out. I could check old phone bills etc etc.

could anyone please advise if a loan provider is required to provide regular statements??

    many thanks

    Hi All

Just wanted to post what a !!!!!! day I have had today. I learnt that a very dear and admired colleague died today. When working on an acute mental health Adolescent Unit you get so used to relying on your colleagues. When you go in for your shift you look who is on the rota and you know if it is going to be a good or bad day. I worked with this person about five years ago on nights he was a trained member of staff and he was the most wonderful, funny, charasmatic, supportive individual I think I have ever worked with. He loved his family and his children so much, he was handsome. knowledgeable, and what more can I say. His life support was turned off today he was 47. He got an infection and died within a week. I am so devastated.

I know when somebody dies everybody says what a wonderful person they have been. Even if they were a complete !!!!!! people are nice. What I am saying is that he was genuinely a wonderful warm lovely human being and I send all my love to his family children and newly born grand child.

I know this is not PPI but it has been a bad day. I know nobody can made if better and I do not expect anybody to say anything to make it better cause you cannot. I just wanted to share it with you all.:embarasse

    Hi hun
They have 8 weeks to respond.;)
These should be okay if they were taken out in 2002.:D ;)

Good luck hope you hear soon and don't forget if your unsuccessful with these you can then move on to the FOS, but wait for the final response first and see what they say, some give you a chance to write to them again with further information, but if you let us know where you hear from them we can guide you from there.

Me again; this is the letter i sent off, is there something wrong with it?

I received a reply from Welcome a week after sending almost, this is their reply.

    Dear Sirs

    Your ref: 1234

Thank you for your letter of concerning the above.

We find the letter confusing in that it simply lists a number of statements loosely based on FSA rules without explaining the actual nature of the customers complaint.

If you genuinely believe we failed to deal with all the items listed when we sold the insurance then please confirm this. Otherwise please specify in detail the exact nature of the complaint so that we do not waste anybodys time, particularly the customers.

When we receive this we will retrieve our files and investigate.

Should we not recieve a response from you within 8 weeks then we will close our file.

    Yours....

    Whats my response now? :)

    Thanks
This is where making up your own letter and wording it yourself is much better than statements from the template.

I would just write back and state that the policy was missold to you and put into YOUR own words why and ask them for a final response.

If you need any help just shout..;)

Its been 5 weeks since 1st letter sent. Do I wait for another letter or do I send 2nd letter now???
I would maybe write another letter just enclosing a copy of their first letter and ask them for a final response in the matter.
