Please try not to get too stressed over this,it's still early morning,I'm sure before long more knowledgable folk than me will be along...I can't imagine they can take car if it's in husbands name though....can u try calling citizens advice?Like your idea of parking it in a mates garage too..chin up love, you'll know more before the day is out..keep checking on here, and do some research....fingers crossed for you....SRM xx

  • thanks for replying feel like curling up in a ball and crying so hard when your panicking about this

    just looked at the last letter they sent me it has notice of seizure and nventory of goods

    inventory of goods= our car in my husbands name but council tax in mine and all their letters in my name

    at the bottom of the letter it has plus all other goods on premises except those specifically exempt by statue and council guidelines and she has put two asterixs by them

    dont know what is gonna happen next

    please help

    Just a thought-might be worth removing a wheel or two from car? Make sure they know it's not yours too....Whatever you do-don't open the door !!!!!

    would advise leaving windows closed too, as if any are left open they see this as an invitation to break in!

    Mrs Boop, sorry to hear about this. I have no real knowledge about the situation but I would definitely hide the car as well as you can. Then lock the doors, windows and don't answer if anyone comes round. Also, phone your local CAB as soon as it opens this morning and talk to them.

    ok, I understand your pain. Here is a letter that I sent to bailiffs when I had this same problem last year. It is a template letter that I got off a website (can't remember which one, but I will try and find it). Send this to them via e-mail and copy in the council. Remember that once they have recieved an offer of payment from you in writing then they cannot come and take anything until they have responded in like. The council will not approve of them trying to bully you into paying more than you can afford so make sure you copy them in to all correspondance and forward any and all responses you get from the bailiffs so that they are fully aware of the situation. Once I did this then the bailiffs suddenly magically agreed that they could accept £50 a month. I would also check google re law regarding charges that can be applied to your account. There are very specific laws regarding what they can charge for council tax arrears. Make sure that they are not trying to con you. Hope this helps.

    I understand XXXXXXX Borough Council has appointed you to recover my Council Tax Liability arrears for 2008 of XXXXX

    Firstly I would like to make you aware that I am fully aware of my rights and you will not gain entry to my home under any circumstances to levy goods and I know the fees allowed under statute and when these fees can be applied.

    Due to my circumstances I am unable to pay this in one payment. I advocate a payment schedule of XX months with XX months payments at £50.00 and the balance of XXX to be paid on the XX month to cover the principle. I understand this may seem a long time but this is a realistic offer that is affordable to me and will allow me to pay future bills issued for Council Tax without them falling into arrears. A greater amount would cause me real and actual hardship. A statement of earnings has been attached to this e-mail for your records.

    I am able to pay the above amount on the 30th of each month.Please advise how you would like future payments made. My personal preference is payment by Standing Order.

    It should be noted that I am not at any point refusing to pay this debt but only asking for a fair payment period considering my circumstances. And if you are unable to accept my offer I will place the money aside each month until such a time the council take the account back into their management, when I will make payment of the set aside money to the council.

    I am sending the council a copy of this letter and requesting that it be filled with my account for further reference.

    I hope the above meets your approval and I look forward to your timely reply by letter.
