Cca Requests Updates Please

Having started on this action in DEC , THREE DCA have all failed to provide an enforceable CCA !

    I didn't join in on yours but previously did a catalogue one and am in the middle of one I think today is 12+2.

    I don't get any peace of mind out of my catalogue not returning a CCA they sent it back to original company and that leaves it kind of in limbo.

    What if the original company provide one, or chase me for the debt all I have proved is that a DCA can't do it - so I kinda feel no better requesting CCA.

    Only reason I did mine was when two DCA were after me and in the latest a payment had gone missing and it was going to cost me £5 per cheque to prove I had paid so I figured the £1 to request a CCA was cheaper.

    Do you feel peace of mind now you have not had them returned?

    hi stapeley,

    i requested CCA's for 3 DCA on 22/1/08. Triton who are looking after RBS account, got RBS to send it.. i think Triton are actually RBS in disguise maybe im wrong though.
    Moorcroft yesterday sent a letter plus my postal order back as they said they couldnt provide it as 'they are no longer dealing with account'. Marlin sent me a letter on 7th feb, saying that they do not have a copy of aggreement on file, but will request it from sainsburys bank and will provide when its forthcoming.

    Having read your thread stapely, I sent mine off on saturday, all been signed for yesterday and today, so will count the days down. I have been paying mine for over 6 years now and doesn't seem to be reducing, passed from dca to dca, so am hopeful no CCAs will exist now. Well I live in hope. :)

    As I have said before, in the past c c companies and loan companies have been very lapse with paperwork . Often sending out cc with only application forms supplied . This !!!! up has been covered by the amendments to the CCA in 2006 .
    I know I only filled in an application form for a SKY CARD . I never signed any AGREEMENT , I never agreed to the OC selling on the account to a DCA . I never agreed that a DCA could ring me at all hours and could send threatening letters. So I reserve the right to request any DCA or OC to comply with requirements under the CC ACT . And if they can not, I WILL POINT OUT THAT ANY ACCOUNT THEY MAY HOLD IS UNENFORCEABLE .

    Yes thats the problem it will never reduce much , why don,t the OC offer to clear the debt at same rate they sell to DCA.
  • A quick question that I could do with some help on :

    If a debt I have been paying for four years via a DCA do not manage to give me a CCA in the time allocated, does that mean the debt is still enforcable seeing as i have accepted the debt (verbally) and have been making payments? :confused: Or is it unenforcable? :D If it is unenforcable, can i claim my payments back? :j

    My CCA request was sent Monday am currently awaiting a reply.

    Some will say if a CCA is not produced ,and you have been paying you can claim your money back . Some I believe have got money back .But I think you need to be a legal wiz ! Once you have requested a CCA the account is in dispute , and no action can be taken on the account. If a CCA is produced after the time limit , the debt can be enforced only by a court order .( you had better check that for yourselves )

  • hi my partner left his co-op bank account £250 overdrawn about 4 yrs ago. can i request the CCA? Lowells are chasing him.
