I'd send an NBA for a one week response and immediately issue Court proceedings, we regularly read stories like these, don't be the next innocent victim of there underhand antics act NOW!!!

Thanks guys, will give them a call this week, first based on your recommendation to record the call and then look at issuing the NBA verbally (and then via e-mail after).

If you want to follow Mark2Sparks advice go for it, even I have to bow to his advice, he's a clever guy, but I would skip the verbal NBA and email NBA, they have traditionally been issued by letter post, you can even get proof of posting for free.....After reading PtL Vaubans Guide , please don't desert us, hang around and help others!

You cannot issue a "verbal NBA" - there is no such thing.
In order to commence legal action, you are expected to write a formal Notice Before Action (which can be done by email). This should ordinarily give the airline at least 14 days to respond before you commence legal action.
When did you fly in May 2009? Because when you reach that date, you will be out of time unless you have started legal proceedings. So you have almost no time left before you automatically forfeit your compensation.0 -
