    Valid claim most likely, don't know why Monarch issue the threatening letter - they will not give you details of the technical problem and will only reveal same to a Judge. If you are fed up of waiting take them to court, otherwise wait but make sure you don't let them string you along for 6 years from August 2014 .... they are quite capable of doing so.

    Thanks, that explains their lack of response. I have read quite a lot of the Monarch thread, particularly the later correspondence. Thanks for the warning re 6 years - I intend to see what the fall out is from the recent ruling (if any but not optimistic) and then move along to NBA etc. Unfortunately I am not a FACEBOOK user (but have access through a granddaughter), and after this post I will put any subsequent posts on the Monarch thread. Thanks again.

    thats not necessarily true, told be what the problem was on mine

    Our records show that the aircraft scheduled to operate your flight became
    unserviceable in Mombasa due to a ruptured start duct in
    the number one engine. Qualified engineers were dispatched from Manchester with
    the required parts in order to rectify the fault

    Well, it has taken nearly 2 years but I have finally received compensation for the above flight. :T

    Briefly, the flight was over 2 hours late leaving due to (i) Late arrival of incoming flight (ii) Technical issue (speed brake fault) & (iii) Aborted take off due to warning light, which meant, by the time we arrived at Gatwick, runways had been closed due to snowfall and we were diverted to Stansted.

    I maintained that, if we had left on time, we would have arrived before the runway closures but TC simply cited "adverse weather conditions" and, after 2 emails, closed the case, refusing to correspond further, leaving me with no option but to go the legal route. :mad:

    I initially issued the claim for my whole party via MCOL and it was finally heard (on paper) on 26th Jan 2015 at Manchester County Court by DJ Hovington who awarded £1800 (in total) for myself & 3 fellow passengers stating "it is clear that a significant cause of the delay was in fact that the aircraft was 2 hours 20 minutes late in setting off from Sharm el Sheikh for reasons which would not, on the present authorities, constitute "extraordinary circumstances"."

    Whilst I haven't posted on here before, I have pretty much read everything everybody else has :D and I have no doubts I couldn't have done it without this forum. The advice contained on here (and, in particular, in Vauban's Guide) is absolutely invaluable.

    In my experience, this is definitely not a process for the faint hearted - it is labouriously slow and often frustrating and I suspect TC (along with all the other airlines) rely on the vast majority of us giving up along the way.

    Thanks again to the many contributors on here and good luck to everyone else with their claims.
  • I am looking for Court rulings from any European country on the subject of EU 261/2004 compensation for infant passengers travelling with their name registered on the ticket (for which a fee was paid) but without a separate seat reservation (infant travelling on the lap of parents). The airline I am claiming is refusing to pay compensation for our infant since they claim a reservation of a separate seat is necessary for EU 261/2004 to be applicable. I am aware of the success of another member of this forum (girlneedshelp), but have so far not been able to obtain any documents for this case.
    I would very much appreciate if you would share any references that I could use to support my case in Court!

    You really shouldn't need it. The regulation is quite clear on this matter ie compensation is due each fare paying passenger , irrespective of any seat reservation. Which airline?

    I am sorry if I posted in the wrong thread. Since you have a much longer history in this forum than I have, maybe you could tell me where I should post so that I dont make the same misstake twice..;-)
