I have just received in the post cheques for all those in my party who were delayed from Orlando, May 10th 2012(vs0016)
Well done!... a letter from CAA to Virgin seems to have paid off.
What did the CAA leter say? Looks like an interesting development as I had got the impression the CAA couldn't achieve much. I might give them a try if they can influence positively.0 -
Just had a response to my NBA which I posted to Crawley address on June 5th.
It appears Virgin aren't even reading the letters they receive as their response was to send me back my NBA with a standard letter instructing me how to make an application for flight compensation!!! Why on earth would I need instructions on how to submit a claim when I have already done that step and received a rejection! There couldn't be any confusion as I used the NBA template, filled all details in and included claim my reference number etc etc
This is beyond a joke! I'll still give them the 14 days then I'll start my claim in court
That is exactly what has happened to me, after sending my NBA almost 14 days ago. I, too, used the template, included the reference numbers from my one piece of correspondence from them 19 weeks ago and I have my letter returned to me and two claim forms. Helpful. So I shall be waiting until Monday and then filing my claim with MCOL. Does anyone have a specific name to whom the claim should be addressed in the court paperwork as all I have is the name of a customer services manager on the EU claim address, not head office. Branson himself?

Just wondered if anyone had started their process of claiming for the delayed VS074 flight from Orlando to Manchester, that eventually took off 25 hours late on Saturday 8th June, the reason announced at the gate was the pilot had called in sick at 18.30 and that in the subsequent 2 hours they couldn't find a replacement so they had no choice but to delay the flight? Would be nice to hear of any successes, my letter will be in the post with all the forms etc by the end of the week.
To the experienced forum users on here, from all the feedback I heard on the flight, a pilot calling in sick and a 25 hour delay for Virgin Atlantic flight Orlando to Manchester, this seems to be a genuine claim for €600 per paying customer?0 -
Of course it's a genuine claim. Aside from sickness not being extraordinary in any shape or form, a 25 hour delay doesn't sound like Virgin bent over backwards either.

Yes, we are in the process of completing the forms. Virgin were an absolute disgrace on this flight.
All ready to board with the screen at gate still saying boarding at 19:45, then they announce that the captain had informed them at 18:30 that he was sick and could not fly and now there would be a 24 hour delay, which then turned into 25 hours.
I can except sickness as exceptional if a couple of hours delayed, but 25 hours was ridiculous. Especially when considering there were three further flights to the UK within a two and half hour period before ours.
Claims will be going off this week.0 -

Dec 31st - sent initial letter
Early Jan - was told to complete forms
Early Jan - sent back forms
Mid Jan - confirmation that they had forms - reply due in 6-12 weeks
Late Mar - declined due to Extraordinary circumstances
Mid April - issued NBA - no reply...
9th May - started claim via MCOL
20th May - Virgin said they would defend all of claim
Today (12th June) - cheque for £2108 received

Seems like Virgin tidied up their court claims as I also just got home to find they've settled my claim. Cheque for £1500 in my hands!
Flight on the 2nd June 2008 Gatwick to Orlando delayed by 5hrs 55 mins due to needing to replace the fuel pump bolts.
Virgin should learn their lesson from this, my original claim was for the €600 x 2 but since they forced me to court I added on interest (since Centipede100 enlightened me) and it's cost them nearly £500 more with court costs than if they'd just accepted my claim.
