However, just point out that unenforceability is a right, it isn't wiping the balance because the debt remains and if they can find the CCA at a later date they can then enforce it again (only to a maximum of 6yrs - limitations act would then supercede the CCA)......

So what has happened to the days when CONSUMERS were repsonsible for their finances instead of laying the blame at the feet of the banks.

As for calling people stupid, I think you're bang outta order. That is your opinion which should be kept inside, who are you to call everyone stupid? They are not stupid, more astute.

1. I called 'some' people stupid. I mentioned no-one in particular 9although you fit the bill perfectly).
2. You call me stupid for paying my debts. If there were more honest people like me and less idiots like you that condone dodging bills then maybe this mess would never happen.

just wanted to throw my two penneth in....
What about those of us that enter trust deed's IVA's or bankruptcy?
I always thought that that was fairly responsible of me to stop worrying myself to death about all the debts that I couldn't repay and pay into a trust deed that would eventually pay off all my debts at a much reduced rate.
Oh and if you're interested my PPI which I paid a fortune for never paid out when I lost my job because they claimed that as I was a student I didn't qualify, I then got hauled up infront of the fraud squad at the job shop hours before the final exam for claiming benefits despite the fact that the course I was on was tuition paid only, no bursary or grant. Oh and I failed by the way.....any wonder.0 -

These threads always degenerate into a slanging match. Why ??
Fact is, there is a possibility that pre-April 2007 debts could be unenforceable on legal grounds. This is fact, not disputed.
For those suffering financial hardship and excessive threats or demands from DCA's this is a tool that can be used to make life easier.
This again is fact, some people object, some don't, but it is there and is a tool that can be utilized to attack debt situations.
If you don't agree with this cause of action, then that is fine, that is your personal moral stance.

Funnily enough, I thought that was the idea behind credit checks - that the bank actually checked the consumer could afford it, rather than just assume.No Longer works for MBNA as of August 2010 - redundancy money will be nice though.
