    I think there should be a letter inbetween these.

    Nope, the only letter in between is any that may come from the lender. You send the CCA request first then if they don't respond you challenge the legality, i.e. letter 2.

    The final step would be to demand they remove the data or substantiate it, which if they haven't responded within the prescribed times, you know they can't provide the original document.

    Point to note - never speak to them on the phone so never give your number and never ever ever sign anything with your real signature. Why?

    Ok, lets say 'someone I know' sent off a CCA and signed his name totally different and even went as far as putting little circles above the i (in surname) which he never does (this is a 50 something bloke!).

    Anyway, when he got his CCA back guess what? The exact signature appeared on the agreement but what was funny was that he never signed like that before and took a photocopy himself. Suffice to say it was proven they had cut and glued it onto a blank CCA (dirty tricks)

    So trust me - dont sign! I use a font to do it electronically anyway now.....

    Yup they pre judge us but you know what? sod em all cos they are the mugs paying when they don't have to! Loyalty to a bank is the same as standing by a cheating partner which you know what, I won't put up with that!

    Let them get on with it, you know what, when my debts get written off i'll have a drink on them knowing they'll be paying higher rates because of my dirty shame :D

    Never in Doubt - that forging the signature business, would the lender have to show the actual original paperwork in court OR just a photocopy ? If they copied a signature onto a blank agreement, then it would not be a real ink signing and that would be clear to see - so what's the score there?

    Does that happen often? Or is it a one off case?

    Also, I got a reply from Barclaycard Data Protection Service Department - and their officer states after I request my CCA copy...:

    "Unfortunately, we do not hold a copy of your application in our records."

    I guess that's their way of saying that they dont have my agreement, right?

    PLEASE GOD tell me it is.!
