    After reading through your thread, I must stress it is vital that you send off the CCA request as quickly as possible. Remember to send it recorded delivery and dont forget the £1 fee.

    It is very likely that they will be unable to produce a valid credit agreement, and therefore WILL NOT be able to take you to court or place any sort of charging order on your house.

    They scare you with these threts to get you to accepting their terms. Dont give in to them. If you play everything by the book, then you will come out on top. They have been hounding me for nearly a year now and they still haven't taken me to court and I now know they wont because they dont have a valid CCA!

  • Thanks cocker100 will get the letter sent of today recorded and not signed must remember that.

    I am hopefull that they dont have a CCA as the card was originally taken out around 2000 but we did change it over to a different card with Abbey (MBNA) around 2004 and I can not remember them sending a form I am sure he did it over the phone.

  • Letter is done. Being sent to the address on their website in Reigate as was unsure if you send recorded letters to a PO Box.

    Edit - just checked the post code they have on their website, it does not show on the post office website so did a search on the adress to get the postcode and instead of 7JP it is 7LD. Wonder why the difference. Anyway sending it to the postcode on the post office website as I know when i get to the post office the man behind the counter will question the 7JP postcode as it wont show on his system.

    Lesbourne Road
    Reigate
    Surrey
    RH2 7JP

    Post office have never questioned it.

    I sent my very first letter to them to their PO Box number and it took ages to get to the right department. Have used this address ever since. I always get a letter from them to confirm receipt when I use this one and have quoted "compliance officer"

  • Cocker100 normally I would have just sent it but our post master is a bit of a stickler and I have been in the q before and he has been very loud in telling people that the address is wrong and I did not want to have him shouting my business to all the nosey so and so's where I live. However I am sure it will get there. But I didn't think of sending it FAO the compliance officer will note that for my future letters (i have a feeling there will be lots more)

    Please get the message throught to OH that he needs to ensure that he does not speak to DCas on the phone.

    What proof will he have that he made the call, of the contents of the call etc if it does go to court. If you do everything in writing, then you have documentation to support you if it ever gets to court.

  • Thanks RAS I am trying and normally he just does as I say (where the debt is concerned) however the the threat of legal action is getting to him, however I am hoping now the CCA letter has gone out he will relax a bit unless of course they produce one.

    The guy on the phone the other day was pressing for his employment details and info on the equity on the house but he refused to give these out so he is taking some things on board.

  • According to the Post Office 1st Credit have received out CCA request so just going to have to sit and wait to see if they reply.

    ON a positive note I have a job :j so hopefully we can up our DMP payments enough now to keep all our creditors at bay, however I am wondering how it works when you are able to increase your DMP payments by such an amount that you end up paying more to a creditor than you would have before the DMP. I hope that makes sense. Also we are considering leaving CCCS and going it alone. Do you think this would be a bad idea?

  • 1st credit have replied to our request for our CCA. They advise it is held by MBNA and will request it from them. No note of it saying it may take longer than the 12 days.

  • Hi LFTS,

    Have a look at what they have sent me in relation to my CCA request for my Morgan Stanley card. It is a joke and am certain it is no way enforceable. Mine too was retained by OC and it took them well over the 12 days to send me it.
