CCJ from Parking Eye

Hi,
I recently discovered when being rejected for finance that I have a CCJ on my record. This was of my own doing as I received no correspondence due to temporarily moving addresses and not changing an documents (It was only temporary).
I have since emailed parking eye to get the reference number, that you need for any service of theirs, i.e phone or even to pay the charge. This is for an incident that happened in 2016.
I have since responded explaining that I am willing to pay the amount if they agree to a consent order, so I can have the CCJ removed from my file by consent. The only response they have given me is that my debt was passed on to Debt Recovery Plus and all correspondence I make must be with them. This seemed a bit odd? They didn't provide me with any contact details at all.
Has anyone any experience with having one of these passed through, or any other information that might help me?

Clearly PE have not understood your request. It could take ages for the penny to drop. Why not go for a without consent set aside. Meanwhile, complain to your MP as it is the will of Parliament that these scammers be put out of business.
Hopefully that will take place in the near future. The Bill has passed through the HOC without hitch, and goes to the Lords soon. In the meantime involve your MP, the poor dears are buckling under the weight of complaints about these scammers.
This is an entirely unregulated industry which is scamming the public with inflated claims for minor breaches of alleged contracts for alleged parking offences, aided and abetted by a handful of low-rent solicitors. Is has been suggested by an MP that some of these companies may have connections to organised crime.
Parking Eye, CPM, Smart, (especially Smart}, and others have already been named and shamed in the House of Commons as have Gladstones Solicitors, and BW Legal, (these two law firms take hundreds of these cases to court each week), hospital car parks and residential complex tickets have been especially mentioned. They lose most of them, and have been reported to the regulatory authority by an M.P. for unprofessional conduct
The problem has become so widespread that MPs have agreed to enact a Bill to regulate these scammers.
Sir Greg Knight's Private Members Bill to curb the excesses, and perhaps close down, some of these companies passed its Third Reading in late November, and, with a fair wind, will become Law next year.
All three readings are available to watch on the internet, (some 6-7 hours), and published in Hansard. MPs have an extremely low opinion of the industry. Many are complaining that they are becoming overwhelmed by complaints from members of the public. Add to their burden, complain in the most robust terms about the scammers..You never know how far you can go until you go too far.0 -
email their enforcement team and insist that they deal with you directly as they applied for and got the CCJ, drpl did not0
-
Did you email enforcement@ ?
They normally play ball with consent orders.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

I have now received an email from DRP as obviously PE have passed on my info! PE have continuously told me to pay on their website, and I am also receiving emails from DRP to pay through their website. Attempt at a double recovery??
Yes it was enforcement that I was emailing!
I wasnt sure if an N244 would be be worth it for 2 reasons, 1. it is a PCN from June 2016 and 2. I have already emailed PE saying I was willing to pay if they agreed to a consent order. Would that not be seen as proof that I have admitted to the offence?
Any further help would be much appreciated0 -

Not imo. It could signify that you do not have the time to devote to this, or the inclination, or the ability. If you are a hot shot divorce lawyer or a hedge fund manager this could represent 10-15 minutes of your valuable time, or you could have won the lottery.
Please involve your MP in this, it is an injustice which need to be corrected as it the will of Parliament that these scammers, (very often former clampers), be put out of business.

If they won't consent to a set aside then your options are limited to either pay it and live with a ccj or a set aside without consent. One other option is to live with an unpaid ccj. Wait and see if they attempt enforcement. Up to now they haven't done.
I hate to say but it's your call.0 -
Living with it is not really an option as me and my partner are looking to buy a house this time next year, so I could do with it gone ASAP so I can get my credit rating back up to scratch!
What are the chances of completing an N244 and it being set aside?
I have also advised DRP not to contact me again as I see it as an attempt at a double recovery and the CCJ is not with them. Is this the right way to go about it?
Do I try enforcement again, or just go straight ahead with the N244?0 -
You are expected to apply for a set aside promptly. There are no set rules as to what promptly means but it's generally taken as 28 days from discovering you have a ccj.
Any longer than this runs the risk of an application being dismissed due to not being prompt. Faffing about emailing people doesn't lengthen the timescale.
You can mail them if you have plenty of time but the clock is ticking somewhat.
Odds of it being given? Who knows. It's impossible to say.0 -
You have a lot of work to do, and youre sitting on this.
You must NOW, TODAY, decide if you are going one of two routes:
1) Consent order - for which you need to pull your finger out and ensure they contact you back. If they dont, then you have no choice but to try
2) Without consent - this means a draft order, WS to support the set aside, and a draft defence to show you have a reasonabel chance of success, if you dont have an automatic set asied granted (automatic being they served at the wrong address, for example)
You cannot prevaricate on this.0 -
I agree, if they are faffing, go this week for set aside without consent. We do see pretty much ALL of them agreed on here but the Judge will want to be satisfied that:
- you acted promptly when you discovered the CCJ and could not reasonably have been expected to have filed the N244 much earlier, and
- that you did not receive the claim so were not given a chance to defend, and
- that you have more than 50/50 chance of defending the claim if reset.
Search the forum for set aside 6 point draft order and copy what others have done.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).
