  • I can get it done today, it is just the choice of which path to go down. I have sent numerous emails regarding a with consent and am not getting anywhere with that. My emails are just being diverted and I cant get a decent response from anyone.

    I am unsure on how to outline a defence in terms of the set aside without consent. Is there somewhere that has a draft I can use?

    I just want to get it done ASAP, but it needs to be right.

    Have you tried calling them? Writing a letter? Doing anything other than an email? If one way isnt working, then if you truly want a "with consent" set aside then YOU have to make it happen. We cant.

    Have you read post 2 of the nebwies thread? OR the search above?

    Research first....

    Im telling you that, if you are nto getting a response on email, then your only option is to call them to get the ball rolling.

    Otherwise you have to go the "without consent" route.

    That depends, you say that you moved out of your house temporarily, did you move back to the same house?

    If so, a judge might ask why you did not arrange a forwarding address. Did you retain possession of the house in the meantime? A judge might also be concerned that you did not inform the DVLA, how long was "temporary"

    Have you complained to your MP?
    You never know how far you can go until you go too far.

    Hello,

    I have just been to court to get a set-aside and its not gone well.

    I had a parking ticket sent to an old address (as I had not notified the dvla). Found ccJ in 2016, wrote to their solicitors without reply. I recently went for the set-aside after reading these forums. Sat with judge and their side did not turn up but sent a late defence so have had the process adjourned. The judge also said my defence ( a blind defence I got from the forum mentioned above as I did not know the reason for the ticket) was basically useless and that I would have to prove I had a reasonable chance of winning. However the judge told me I'm very late filing the set aside and that will most likely lose it for me. He said it would probably be fatal! 59 days max to file it unless you have a great reason. Also their defence that I've just received is pretty good, very detailed, with images and a full detailed signage brochure, showing their fine is within standards etc. He also said if they did turn up to defend and I lose I would be liable for their costs. Wish I had just paid it saved the £250, all the work and time and moved on. I'm thinking just pay the fine and back out as I'm going to lose. I suggest you do the same. Its a lot of work and time and these large parking companies know what their doing. Also the main thing I took from being in front of a judge is that I'm no lawyer and thats what you need to be in court! or at least have one

    NOSFERATU1001 I'm just a normal person thats followed advise from people like you who think they are lawyers. The hard truth I've learned is that if I just paid the fine I'd be £250 better off with less stress. Are you going to be there to pick up the pieces IF the advise you give fails however well intentioned it is? I'm just trying to save this person some major hassle and expense based on my experience. I don't see how that is highjacking the tread. I never asked for advise. Its a forum that how these things are surly meant to work.
