Hi forum,

Having read the forum notes i believe i need to start a new thread as the County court claim letter has arrived and i feel sick to the stomach and i really don't know where to start. I guess The first question is how do i discuss it on an open forum?- which details /facts do i write and which do i hold back? I am quite lost on this forum so apologies if posting incorrectly.
I would like to add a defence - shall i just post a draft defence and is it best to complete online viamoneyclaim.gov.uk or via the court documents?

    Reading between the lines it looks like you have found the Newbies thread. Post 2 covers the court process and includes a pictorial walk through of how to complete the forms and when.

    Post up the particulars of claim (suitably redacted of course) and a draft defence so regulars can look over it.

    There is little point in "hiding" your defence as the parking company get to see it in plenty of time anyway.

    Do not file your Defence via MCOL.

    What is the Date of Issue on your Claim Form?

    Post #2 of the NEWBIES FAQ sticky thread has comprehensive guidance on how to proceed. The first this to do is the Acknowledgement of Service as described in a Dropbox file linked from there.

    Is this case linked to your thread from 2016? If so, it will be better if you copy and paste your query above into the original, because all the back-details are there for regulars to see the context - like this being an 8-ticket case.

    Ok,

    Date of issue on the Claim form is 14th Sept

    This is the same as the thread for 2016, was unsure how to proceed. I wasn't very clear in that thread (apologies) it is not a 8-ticket case - the reg keeper received the same letter 8 times - in as many days )

    It might be prudent to note that I am currently in recovery from a breakdown and further mental health complications so i find this kind of process both overly complicated and very difficult. Errors and slow response time is unfortunately a part of my everyday. I will endeavour to keep up..

    With a Claim Issue Date of 14th September, you have until Wednesday 3rd October to do the Acknowledgement of Service, but there is nothing to be gained by delaying it. To do the AoS, follow the guidance offered in a Dropbox link from post #2 of the NEWBIES FAQ sticky thread.

    Having done the AoS, you then have until 4pm on Wednesday 17th October 2018 to file your Defence.

    That's over three weeks away. Plenty of time to hone the Defence to perfection.


    When you are happy with the content, your Defence should be filed via email as described here:

    1) Print your Defence.
    2) Sign it and date it.
    3) Scan the signed document back in and save it as a pdf.
    4) Send that pdf as an email attachment to CCBCAQ@Justice.gov.uk
    5) Just put the claim number and the word Defence in the email title, and in the body of the email something like 'Please find my Defence attached'.
    6) Log into MCOL after a few days to see if the Claim is marked "defended". If not chase the CCBC until it is.
    7) Wait for the Directions Questionnaire and come back here.

    Do bookmark ALL of them - I've been giving all of the 'PPS defence group' all the usernames. I did tell all of you, swap pm's and look at each other's threads and defences, you can all support and help each other so we don't have to reply again and again on all ten or so threads (that are all the same!).

    Time is vanishing quickly.
