Firstly thanks for newbie thread, most things are covered. My question is about the 'different' elements' of my case and how my letter will sound. Context.
I received a letter from PPS dated xth Dec - along with 8 more of the same on the X/12/12
The charge is now for £100. I never received a window sticker and i bought a ticket. edit.................
Do i take issue with the lack of ticket? is there harassment 8 letters the same? ( which i have kept ) do i follow the BPA template if i do not know about the land (just a rubble covered carpark on a side street.)

    If they are for 8 events, appeal all 8 separately. If they are all for one event, appeal using the appeal once.


    Use the template in the NEWBIES thread and appeal AS KEEPER.


    Please give us the exact name of the PPC as there are so many and often posters get things wrong when the quote just the initials. We will need this to know if they are BPA or IPC members.


    If you got a windscreen ticket then the NTKs are too soon to meet POFA 2012 requirements and therefore the keeper isn't liable.

    I think you mean "if you did get"!

    And if these are 8 separate events then the PPC has to apply for the RK's details each time; i.e 8 applications to the DVLA!
    Reads like it was the same event.

    So to correct and clarify ( yes apologies, i too was running out the door... to star wars!! )
    PPS = premier parking solution.
    Original parking contravention is 07/11/12 not 07/12/12 as i stated, sorry
    The eight letters i recieved are all for the same contravention on the 7th... OTT and i should have received a windscreen ticket but i found none.

    If ANPR was used, you don't get a windscreen ticket but the NTK has to arrive by day 14 after the alleged event, that day being day zero.


    If no ANPR then there has to be a windscreen ticket and the NTK must arrive between day 28 and 56 again with day zero being the day of the alleged event.


    Since there was no windscreen ticket the PPC is out of time and the NTK is non POFA 2012 compliant.


    Send the appeal template letter from the NEWBIES around day 25. It's up to you if you want to add that the NTK does not meet the requirements of keeper liability, but if you do, make sure you don't reveal who was driving.
    Alternatively use the non compliant NTK for your second stage appeal.


    PPS are BPA members so this should be easy to kill off at PoPLA and cost the PPC money at the same time for the privilege of losing.


    Meanwhile, complain to the BPA that you are being harasses when you are still within the appeal period, but don't let on that the NTK is non POFA 2012 compliant.

    so i'm writing in the example letter template as below, shall i add the complaint to the BPA as well about the harassment ? i'm adding the NTK . lack of windscreen ticket etc.

    i am a little unsure about wether i keep the bit about signs /land ownership. keep that in ?

    My opinion is to either put in the minimum and save the big stuff for PoPLA, or put the lot in, not half and half.


    If you add anything to the template you must be very, very careful that you don't give away a hint about the driver's identity.


    If you want to add stuff then I suggest you post up a redacted version of your initial appeal here before sending it. Personally I wouldn't risk it and just copy and paste the template letter, but that is your decision.

    so obviously rejected from there 'internal complaints department' that will be dave on desk 4 then!

    You have now reached the end of our internal appeals procedure. Please forward a payment of £100 to reach us by 18/01/2016 in order to avoid Debt Recovery proceedings; incurring additional costs. Please note that if you wish to appeal to the Independent Appeal Service, POPLA, you will lose the right to pay the charge at the discounted rate of £--, and, should POPLA’s decision not go in your favour, you will be required to pay the full amount of £--. By appealing to POPLA you consent to PPS sharing all data that relates to this case with POPLA, and if necessary with the BPA and DVLA. If you appeal to POPLA, you can submit your appeal electronically. However, if your appeal is dismissed by POPLA, we will use their adjudication in future Court proceedings, which may commence without delay and further costs may be added. ______is your designated POPLA code.
    By law we are also required to inform you that Ombudsman Services provides an alternative dispute resolution service that would be competent to deal with your appeal. However, we have not chosen to participate in their alternative dispute resolution service. As such, should you wish to appeal, then you must do so to POPLA, as explained above. If you choose to do nothing, we will seek to recover the monies owed to us via our debt recovery procedures and may proceed with Court action against you.
    NB: If, as the keeper of the vehicle, you do not give the details about the driver or hirer, or if the driver or hirer refuses to acknowledge their liability, you may be liable to pay any unpaid charges in accordance with the Protection of Freedoms Act 2012.

    my question is do i respond to them before popla? do i point out that they missed out all of the future figues " £- " was in the letter. The child in me wants to email and say that i will take that amount in the future!
