Hi, first off I want to apologize if this is in the wrong section. Mods please move if it is.
I have recently read that Carphone Warehouse have been made to pay back people regarding mis sold insurance. I have been paying them through direct debit since 2009 for items that have been gone for a long time. Is it possible to claim any of this money back? To me it has been free money to them. Any help is really appreciated.
Thank you.

Why do you believe it was mis sold to you?
And why are you still paying for it if you don't want it?0 -
It is not me per say that has the insurance. I will need to get all the details in full. It has been a direct debit since 2009 and the person has only just realised it has still been coming out. No letters or emails nothing. It is a big amount.0

Also if we cancel the direct debit today will that affect any claims in the future?0

If the person believes they have been mis sold something, they need to send a complaint to Carphone Warehouse giving their reasons.0

Thank you. If we cancel it today will that affect any claims?0

You can't claim on a policy unless the policy is in force, but you can still put in a complaint.
Mis-selling involves making a complaint.0 -
Ok, so the best thing to do is contact carphone warehouse and keep the policy active? Will they not just fob me off etc? I was hoping they would be a third party to resolve things like this or a template for a claim?0
-
If you don't feel the insurance is worthwhile, there is no point in keeping it active. Why not save on the future premiums? It will almost certainly be cancelled when you put in your complaint in any case, as you will be saying they shouldn't have sold it to you.
There will be no off-fobbery when you put in your complaint.
Don't use a third party or a template. You want to make a genuine complaint, giving your own reasons for mis sale. Not pay someone to make up fake reasons.0 -
It is not up to carphone warehouse to cancel this insurance, it's up to whoever was paying for it. It's their own fault for not checking their bank staements regularly.
The firm have done nothing wrong by continuing to take this money unless you actually informed them via phone call or written word that it was no longer required.
If you did, you have a genuine complaint. If you didn't, you are reliant on them refunding as a goodwill gesture so don't go in all guns blazing. Ask nicely for a refund of monies paid and be prepared to provide some evidence if they ask for it depending on what your complaint reasons are.Non me fac calcitrare tuum culi0 -
