Hi all,
I am back, they have replied with 100pages of information including contracts, pictures, tickets, reminders etc.
To be honest, I am not too bothered about the pictures because like I stated before their ticket personnel were rogues. They gave ticket twice when the car had not been moved at all. On the first day, they took pictures of both front and back of the car very gladly and boldly lots of pictures, on the second day, they cowardly took a picture of the back and another of the front screen to reflect no permit but never taken it as boldly as the 1st day to show that it was still in the same spot.
Here is the content of the reply in short
1) they are pursuing me as the keeper.
2) cause of action is the breach of contract
3) they've broken down the payments to £160/ticket, £60 was added on top of each ticket for dept recovery fee.
FOR THE LEGAL EXPERTS HERE:
I noticed the contract was only for one year and none of the dates on the ticket fell within that one year. However, there was a witness statement from the head of estates stating:
- That UKPC has the authority of the Landowner to undertake parking management control and enforcement at the site.
- This authority is contained in an agreement dated **/**/**** running in perpetuity until terminated.
But the contract has a termination date and both parties signatures, whereas this witness statement is not a contract although it was dated few months after the end of the initial contract and it only has the head of estates signature none from UKPC.......
1) CAN THE STATEMENT BE TREATED AS A CONTRACT?
OR
2) DO YOU THINK I CAN JUST REPLY SCS LAW THAT CONTRACT IS NOT VALID?
3) PLEASE WHAT DO I DO NEXT?

Let the experienced ones on here study the papers
when you upload them.
I am not too sure if a court will allow the £60 add-on fee
for debt collectors
What you must do now is make all your fellow workers
fully aware that ......
As of the 22/03/2018, UKPC were banned by the DVLA
Meaning that all windscreen tickets are now useless
to UKPC as they cannot obtain keepers details
Same with the dodgy ANPR.
It surely is now your job to print off the following
and place it on the notice boards which will scupper
UKPC whilst they are banned.
Even though they will continue to issue windscreen tickets
they will be worthless and can be ignored
Any ticket given out whilst they are banned cannot
be used by UKPC at a later stage

If the debt collectors are Debt Recovery Plus, they work on a 'no collection, no fee' basis.

NO FEE NO CLAIM ?
If it is DRP, highly possible, guess they would be
very pi**ed off with such a UKPC claim pocketing
the £60 per ticket0 -
If DRP have failed to collect they hand it back to UKPC who make the court case.
DRP as stated from their own website are on a no win no fee basis and get nothing, so any debt collectors fees added on to a court claim is fraudulent.0 -
