I think you need to see a solicitor. This may well be one of the few situations where legal aid is still available. In any case, virtually any solicitor would give a free 30-minute appointment to talk about the situation, which is likely to be all that you would need.

What's the plan for your son in the interim? Do you have a Child Arrangements Order or is contact by agreement?

I was advised by the gentleman from social services to continue as normal as it is still under investigation. I guess it’s because everything is just hearsay at the moment & they want to conduct their investigation without my son’s mum being warned of what is going on. There is no formal arrangement in place as up until recently everything appeared to be ok. However, I have printed off a parental plan from CAFCASS which I am talking round tomorrow & I am going to be adamant that I want my son staying with me 5 nights per week as he also wants too. I am not mentioning Social Services to her at this point as instructed by Social Services.

Social Services advised me not to take any further action until they have investigated.
  • I am confused as to why ex pays bedroom tax on a 3 bed house when she has your son and your step daughter living with her?

Sorry I didn't make it clear. My step daughter is 24 and no longer lives with my ex. We moved there when she was younger and we needed a 3 bed.

Unless your local social services have highlighted your son's situation as extremely urgent, I'd be taking him to my house immediately if I were you. After all, he spends the majority of the week with you anyway, what's another few days.
  • If your lad were one of my scouts, I think we'd have hit the safeguarding button by now.

Children (& vulnerable adults) are to be protected. I'm guessing your lad wants to stay with you & for his mum to get help right now, & in a perfect world this all to be a nasty dream he can wake up from.

    Get him, now. Please.

Why only 5 nights. In that situation I would have him 7 nights a week.

Exactly what I was going to say. He needs to be away from that environment full time.

That is sensible, but a 30-minute conversation about what the law can do would help you to see your options more clearly.
