    Here:

    http://www.napierparking.co.uk/assets/Uploads/PDF/Contract-Willen-PT.pdf

    -from which 7 a.
    stands out straight away.
    7. TICKETS.
    (a) It is a condition of this contract that before leaving your vehicle in the car park, you must comply with one of
    the following:
    i. Purchase a ticket from one of the ticket machines within the Car Park before leaving the
    vehicle and the car park.
[how is this possible, if one elects to buy a ticket from a machines?-esp. as shown in pics?] It is essential that the ticket is clearly displayed in the windscreen of
the vehicle. You must ensure that you have the correct change to pay for your parking on arrival. Going to obtain change after entering the car park will make you liable to receive a Fixed Charge Notice because your vehicle will be parked in breach of these Terms and Conditions of Parking. It is still necessary to buy a ticket if a passenger remains present within or near the parked car; or

    ii. Clearly display in the windscreen of the vehicle a Parking Permit valid for the Car Park and comply with the Parking Permit’s Terms and Conditions. These are set out at clause 10 below;
    or

iii. Possess a valid Virtual Permit, details of which are to be found at clause 10 below.

    (b) To be clearly displayed in the windscreen of the vehicle for the purposes of clause 7(a) above, the ticket must be clearly evident to anyone standing next to the vehicle’s windscreen. If, for whatever reason, a ticket is
not so evident, the vehicle shall be deemed not to be displaying a valid ticket, and a Fixed Charge Notice will apply.

    (c) If one of our ticket machines is out of order, you must obtain a ticket from another machine which is
    functioning.
    (d) A ticket from one of the ticket machines may only be used in conjunction with a single vehicle and may not be transferred to a further vehicle. A parked vehicle displaying a ticket which has previously been displayed in another vehicle is liable to a Fixed Charge Notice.

    (e) For the avoidance of doubt, all users of the car park are required either to purchase and display a valid parking ticket purchased from one of our machines to cover the period of parking, or to display a valid Parking Permit, or to possess a valid Virtual Permit.

Haven't seen full posts before necessary edit/deletes, but infer BB has some part in this. If so, realise my observation is irrelevant, but it may help others to see it highlighted.

op- re: c-m's posts #2 and #3. Let me highlight bits for you -

'Stop being intimidated. Not sure why you are getting text messages and letters for payment - if you still have time to appeal to POPLA they should NOT be hassling you at all, they have to allow you time to appeal to POPLA.'
    and
'We will help, forget the hassle - are they really still hassling you NOW despite giving you a POPLA code? If so then complain to the BPA by email (post #6 of the newbies thread).'

Now, a bit of trawling brings up this on pepipoo and recent enough to be relevant[earlier pic.hunt ref.s were 2008]:

See if any of this applies.

Redx and others will fine-tune your draft POPLA appeal. Excellent term from Guys Dad #19 - 'cumulative guru opinion'. Absorb and use, cl.

You must not lose sight of deadline times though or Umkomaas #8, from which I highlight:
'You must now deal with this with a steel-cold approach - and please follow our guidance.'

  • No they have stopped hassling me.

I did not observe any of the signs as shown in the last thread you have posted. I was at Cathedral Tree Car Park just opposite Gullivers land.
  • I do not live in MK.

Are you saying that my last draft was insufficient to win the case?
  • and the photos of the terms and condtions they sent to me do not resemble any of the photos I have seen on the threads.

I haven't seen your draft, so can't comment.

The t's and c's are from their site, as you couldn't post them, #24.

Too much is missing for me to hunt for anything else. Maybe others who saw the fuller versions earlier can progress things now.

#28 - this could - only could - be a strength, if you remember any signage being unlike these, impossible to read, non-compliant in any way. Your reading up on the newbies Threads will make you aware of what is and what isn't.

They're hardly going to send pics that undermine their own fake demand for money, but that does not necessarily mean they are compliant.

  • I did not see any of the signs posted at all. Only the one where the disabled bays are communicating to bay users that they were for disabled badge holders only There were no t's & c's anywhere near them or in the view of the driver or any passengers.

I am going to send my version. This is making me so ill and is making my disabled condition worse.

CL - just one final attempt to make this essential point clear.

PLEASE POST UP YOUR DRAFT SO IT CAN BE CHECKED BEFORE YOU SEND IT.
