sick note going missing

Hello, I hope you can help me.
I have been on the sick due to injuries caused at work since august of last year. I have been covered by sick notes since day 1, and on at least two occasions my sick note has gone "missing".
So, this months pay day came and i got £16.99. When i spoke to HR about this they say they havnt got a sick note from me, yet they still put £16.99 in my bank?
Thing is I have now started sending them via recorded delivery, and have proof that it was signed for and received. On the royal mail website it give delivery time, date, surname of who signed for it and shows their esigniture.
Now can I demand they pay me as I have proof of delivery and if its gone missing its their fault? Or will they just say I cant proove it was a sick note in the envolope I sent recorded?
I know I can get a duplicate from my docs but I have been waiting over a week for them to do it and i rent my house so my landlord aint too happy. Like I say, this aint the first time this has happened.

    You can demand all you like - unless they have the sick note they are under no obligation to pay you. Like they say there could have been anything in the envelope you tracked.

    I would start keeping copies of the note befpre you send them in, better still, scan and email (if they'll accept that) or ask a friend to take in in person.

    That is quite a long time off work. I am also assuming
    a) you are aware you may be dismissed for absence in the end and
    b) you are going to be lodging an insurance claim?
    Debt free 4th April 2007.
    New house. Bigger mortgage. MFWB after I have my buffer cash in place.

    That happened to a friend of mine when off work due to an accident there. He is the type that always keeps copies of everything and just sent them another one. To save him and them doing that again he always fax certificates since then and send the original in post.

    No excuse from employer again about not getting them again.:(

    they cant dissmiss me. they have no grounds to dissmiss me at the moment. But, I was at the spinal clinic last week and the specialist has advised my doctor that i shouldnt carry on in this line of work. So that been said, once the doc writes his report ill most likely get laid off or what ever due to the fact there is no other duties for me in my condition.
    I have also got a claim pending. Im not one for claiming and dont like the idea but I feel like i have no choice if im going to be left with no job at the end of this, whenever that may acctually be. It is starting to really get to me now. :wall:

    Has work got no other duties that you can do, also you could call access to work for assessment for you if you got a disability. Also asked to be referred to their OHA, but you should also put in grievance about your certificates getting lost by them. :o

    As far as im concerned there are duties I can do, and I have spoke to the OHA and the health and safety manager about it. Its my manager who wants me back fully fit. But the thing is the spinal specialist has advised not doing the line of work indefinately. Asin my spine is a mess and shouldnt be subject to the strain the job puts on it on a daily basis.
    The part about the grievance is a good idea, id just feel a little cheeky on account of already putting a claim in against them :o.
    This will maybe be the last time I get ssp from them as they only pay 28weeks ssp, then its the job centre I think?

    duuuhhhhh keep photocopies dammit.

    If you can see them in person. Get a signed receipt from the HR department if they have a habit of losing sicknotes.

    I agree, copy, scan email.

    But check the dates - SSP is only paid by the employer for 6 months - after that date you need to claim from DWP
  • keeping copies of sick notes isnt an issue as the doctors can provide duplicates. They are in my medical records that I am entittled to. Only reason iv had trouble getting my dup is because my doctors seem to of turned useless. I have got a dup now, I rang my solicitor and he said to go the docs and not leave till i get it. And i cant hand it in myself as HR is a 3.5hour drive each way for me. The idea of faxing it is there but they also seem to be good at not recieving faxes aswell.

    Doctors can charge for duplicates and it is not exactly an efficient use of their valuable time. If you have a fax record with a copy of what you send that should be enough to prove that you sent it.
