Car Insurance wont pay out for stolen car.

    Escalate a complaint, there will be details of how to do this in your policy documentation. Probably best to do it in writing by recorded delivery letter as this usually yields results, rather than going round in circles with someone over the phone.

    Make it clear that you are aware of your right to take the case to the Financial Ombudsman Service, this usually 'focuses minds' as it were.
  • Ok. Im really concerned as this has been going on for a couple of weeks already and I am without a car. I didnt have TRC on my policy so I cant get a hire car and I dont have the cash at the minute to buy a replacement. And its 40 mile drive to work every day and it is becoming a massive problem.

    On another note the car was actually broken into around 6 week ago but nothing stolen. I didnt inform the Police at the time or the insurers as I didnt see much point.

    Thanks for everyones advice so far.

    Actually, that new information does change the position somewhat. According to the terms of your policy you really should have informed your insurer of the break in at the time, whether you intended to claim or not (I assume you have told them now?). And to the impartial observer it does seem a little strange that it was not reported to the police. It is still dubious as to whether this is sufficient to repudiate the theft claim though.

    Hi

    I had a colleague who had a smilar problem with direct line. She left her key in her front door while getting something from the house and someone took the keys and nicked her car. It took abot 6 months but they eventually paid up. I would push them all the way, as I too think that they have to prove that the car was taken with the key. They can't just side step the claim by saying that it can't have been stolen without the key. I would also look into claiming any reasonable expenses incurred by them not paying your claim. I'm not sure this is possible, but if you have to take the bus etc, you might be able to claim this back?

    You say "Because i didnt reply they paid out on the claim" this is impossible as without your version of the accident, you insurance company would not pay out.
  • Well they did. Apparently they gave me so many days to reply or they would pay out on the claim.

    My insurers dont know about the breaking I had previously

    Yes they would in certain circumstances, i.e. Road Traffic Act liabilities if they cannot get hold of the policyholder or the policyholder does not cooperate with investigations.
  • Hi i got the same problem my insue is {virgin money}
    BMW 330 convertible 2001 and the company off insurance sayd if i can provide an evidenc how the car it cound be steal with out used key
    I send some profe to them from financial ombudsman service and they said

    You have supplied some internet printouts of the vehicle Key Readers that can be used to copy vehcle keys.I find thind this suggested method imlausible based on the time ,offord and forward planning needed to acquire said Key readers to steal the vehicle ,in order to simpli abandon it 12 miles away and set fire on it.{this is a final response}

    Now how the know if the car it done just 12 miles or more before fire it?
    Or the took the car for criminal things ose is some body how hate me ?????????
    Can any body hepl me please what i have to do or to say

    Can you explain your situation a bit more clearly so we can give you some advice.

    Do you have both sets of car keys?

    How long was left on the MOT?

    Where was the car stolen from?

    How long have you owned the car?

    Was iy set fire to?
