                    Has anyone had a problem with Insurance claims with the Post Office. I mistakenly , when doing online application, clicked no when asked ' have you had any motoring convictions in last 5 years', as I have penalty points for speeding,I did not think this was classed as a'conviction'.
Unfortunately, I was hit by a car, who had been hit by a hit and run driver, and then hit me. My car was written off, and after 25 years of driving with absolutely no claims, I am distraught that my misinterpretation of this has cost me my claim. They asked for a written explanation and I did this but they are now saying my insurance is null and void. They have also now changed the wording and added alongside motoring convictions, fixed penalties, which was not an option when I took my insurance out in April.
Has anyone else come across this problem? Help !!!!

            How many points did you 'forget' to disclose?
 Ignorance is not a defence in law- you are supposed to know the penalties. Motoring points are covered in the rehabilitation of offenders act so it is pretty clear that it is a conviction.0

            unfortunately when taking out the insurance policy it didnt strike me to read up the rehabilitation of offenders act0

 I hear that line at work at least 5 times a week, so forgive the cynicism.
 The only way you have any real chance of getting it overturned is if it is a minor SP30 with 3 points, but you havent said what or how many points you haven't disclosed to them.0

            As FlameCloud righty pointed out, a lot will hinge on how many convictions were not disclosed, what the offences were and how many penalty points you received for them.
 I presume that the Post Office sent a statement of fact or proposal form for you to check after you set the policy up, it certainly doesn't help your case if you did not notice the omission on a document of this type.
 Unfortunately your chances of overturning the insurer's decision are probably very slim, they will have sent your response to be given careful consideration by a more senior employee and usually a voidance is only agreed when they know they are on rock-solid ground.0

            depends on people's version on ther term 'conviction'- to me that would involve a cour case, not a fixed penalty / points added by some [EMAIL="tw@t"]!!!!!![/EMAIL] in a hat..Long time away from MSE, been dealing real life stuff..

 Luckily for me I've never received a motoring prosecution, so I'm not certain - but surely the associated paperwork makes it clear that the driver has been 'convicted' of the offence?0

 Don't want to heap more problems on you but when you take out new insurance you'll have to disclose that you've had insurance cancelled and the reason why !!!0

 I thought i would let you know that , no i am not incredibly thick - when I applied online the question asked ' do you have any motoring convictions ' , perhaps because i have never been to court and been convicted, I wrongly assumed I had not been convicted. - you may think i should not be on the roads, but I am not a danger to anyone on the roads, I simply made a human error, by mis-interpreting 'conviction' and I most certainly am not blatantly at the con, as i mentioned before, i have never in 25 years of driving, made an insurance claim nor has anyone made one against me because i have never caused an accidentOooooooohhhh wrote: »Sorry but anyone who claims they dont think a speeding fine should be mentioned as a conviction is either incredibly thick and shouldnt be on the roads or is blatantly at the con
