Well, as eBay is a buyer's market atm, wouldn't this be a SNAD dispute?

Seller refunds and then claims from RM. If they didn't adequately insure, then that's their problem. If PayPal find against you, then escalate to the credit card company (if possible).

Hold off on opening the dispute until someone who knows more turns up though.

EDIT: Ah, scratch the CC company bit then. Your case is that something was delivered (i.e. you can't claim INR), but it was not what was advertised (i.e. it was an empty envelope). It is his responsibility to get the item to you and to ensure that it is insured in case the carrier damaged/loses/steals it. The only thing muddying the water is that you signed for it. Someone else will be able to illuminate that part.
  • have a look at the original listing - it should tell you weather you have £150 or £500 buyer protection

I'd suspect the seller of posting an empty tampered with package.

All succesful scammers seem genuine don't they? ... else you wouldn't have been scammed - surely.

The package was tampered with, presumably after it was posted!!!

You've not been scammed by ebay ... but you may be the victim of a less than honest postie.

When you saw the package was tampered with - you shouldn't have opened it. You should have reported the matter to the RM (or the police) even if you had not noticed the tampering on delivery.

Now it's been opened, what proof have you the package was tampered with?

Seller can't claim from RM as the item is showing as delivered and without proof of tampering either RM won't pay out.

Even if the buyer were to win a paypal claim, expect a county court summons to arrive in the post as a result.

    helpful tips
    it's spelt d-e-f-i-n-i-t-e-l-y
there - 'in or at that place'
    their - 'owned by them'
    they're - 'they are'
it's bought not brought (i just bought my chicken a suit from that new shop for £6.34)
