Spousal Maintainance - Pls Help

    I would of thought the £4 spousal maintenance would of stopped at the same time as the child maintenance. Does she really need £4.00 per week?

    My friends MIL tried that trick, that fact that she was loaded anyway and still wanted the child maintenance when both her boys were in their 20's.

    go speak to CAB, sounds like this woman is just trying it on to see what she can get, I'm surprised the court sent the letter of arrears.

    The problem is, from what the OP has posted, is that it sounds like the SM was ordered for life - with the only cut off factor being remarriage. In that case she isn't "trying it on", however unjust it may seem. If you have to pay court ordered maintenance of any kind you can't just arbitrally decide to stop paying, you have to get a variation.
    No reliance should be placed on the above.

    Also the cohabiting couple may have taken legal advice. I know of a lady who was left a bungalow to live in unless she got married or lived with a man. The bungalow was to be sold after her death but not form part of her estate.

    Anyway, she did move a man in, but this was 'okay' as long as he paid her rent and was classed as a lodger.

    Personally I think this is against the spirit of the deceased's wishes, and I couldn't do it myself.

    Hi everyone thank you for your thoughts on this - i think this is largely based on principle especially since the child maintainance has ceased, the short periods of time they were married and the fact that why should he continue to pay her however as loftus pointed out to take this back to court could also be quite costly for my parents so at this point im not sure what they will do.

    Am trying to get some free legal advice so if anything useful / interesting stems from there i'll update the thread,

    You may have legal helplines etc as part of your household insurance, or via a work counselling scheme, or via a healthplan.
