I Need Help About Mobile Contracts Please

hi last thursday my stepson who does not live at my address went into the carphone warehouse and took out an 18 month contract at my address. the problem i have is this was done without my permission and even worse he did it with no identification at all he went in with just a debit card and they gave him a contract with 3. the bank account he has is a joint account with his mum as he nedded it when he left school for ema and when he moved out it would have been impossible to change the address that the card is at as he has no passport or drivers licence. anyway we spent the whole day saterday and have got noware does anyone no if there is anything we can do as he signed the form to say he lived here but thats fraud shorley as he does not also he had nothing to prove who he was or were he lived they say because the card is chip and pin they can do that because the card comes back with my address i am going out of my mind as dont wanna get blacklisted beacuse of him as he is not even working and has no income at this time i have the phone and all the contract details as i took it off of him staright away and it has not been used is there an advise line or something to get this stoped and is it leagal to do this if the person does not have any id at all on them to prove its them

Sadly it is your stepson at fault not CPW, they simply did what he asked! He gave them a Debit card with his signature on it (ID proof 1) and the chip & pin machine verified that the card is registered to the address he gave them (ID proof 2) they had no way of knowing that the card is wrongly registered to your address & he no longer lives there! It is him that has technically commited fraud by giving the wrong address, CPW have done chip & pin ID for a while now, it is legal.
As far as I know it is the person who gets blacklisted if aything goes wrong not the address so you shouldn't have a problem unless you are financially linked to him.
If it were me I would drag him to CPW and get him to return the phone as you say he can't pay for it (as long as this is a network that allows it - ring and check first) If you can't return it then make him call the network & CPW to change the address to the one he is actually living at - so that you don't get his bills through your door - if he wants to get in debt it's his problem at the end of the day!Wondering how to have a life & not rack up more debts...0 -

Your phone company might belong to one of two ADR schemes which have been approved by Ofcom:- OTELO (the Office of the Telecommunications Ombudsman) or
- CISAS (Communications and Internet Services Adjudication Scheme).
All phone companies are required to have an ADR scheme. They are breaking important consumer protection rules if they don't. If your phone company won't tell you about its ADR scheme, you can call Ofcom for details, or look on their website – see under heading Useful organisations.

heading Premium rate phone services.

hi,
Not nice situation.
Contact CPW via email with all the details of what has happened and tell them that it's your intention along with your stepson to return the goods in full witihin the 14 days of sale..they will nromally reply within 24 hrs.
Go back to the CPW store and return the goods...
1/ keep/get copy of original contract
2/get a reverse reciept and the name of the sales adviser concenred.
3/ cancel the direct debt instruction ONCE it shows as pending at the bank.
The CPW is only going of the information given,thus if the information given isn't correct then that is possibly fraud,but on your stepsons part not the store.

How old is he? Before this goes any further, how old? If he is 10, then there is one way to deal with it and if he is 25 there is another. And the 2 approaches are not related, because for the 10 year old CPW can't make a contract so your argument is with them but for the 25 year old, there is no argument with CPW, but a big argument with the stepson for using the address.After the uprising of the 17th June The Secretary of the Writers Union

hi thanks for all the help just thought id see if anyway around as its with 3 so there aint but no what im gonna do with him and thats drop in right in it luckerley have been able to close the bank account as is joint with my misses so he had to sign to get it closed today so now he dosent have a bank and have now given his address to three and we will no longer have to do anything and he has no id so no account see how he gets out of that ha ha cheers for all advice0
