    If they broke after 4 months why did you not contact the seller to get them replaced or repaired under guarantee?
  • Because I had had another pair of ghds that had broken in the past and I knew other people that had had the same problem - so I decided to buy a new pair of straightners that weren't ghd and sel the broken ones. Also when we bought them it took a while to receive them etc etc and I had contacted the seller several times and to be honest it all just seemed like too much hassel!

    After writing a very brief letter to the solicitors, I have receieved a reply which states that their position remains the same and that I have to pay the £200. By offerening the irons for sale, they say I have infringed their client's trademark rights and point out that I chose to ignore ebays warning not to relist. Again they state the irons were counterfeit but I would say prove it?

    I would be grateful of any advice as I have not yet sought professional legal advice and in honesty cannot afford to do so.

    Go to citizens advice.

    Personally I would of just ignored there letters if you hadn't signed for them.

    They could never prove you received them.

    They would have to provide the court with proof that the GHD's were fake surely. They can't just make an accusation without anything to back it up. I would ask a friend who has a known genuine pair and write back with the serial number from them as proof.
  • Hm, regardless of the fairness of this case, perhaps lying to the plaintiff's solicitors isn't the most advisable course of action :rolleyes:

    Edit: refunded £515 for TV 1.5 years out of warranty - thank you Sale of Goods Act! :j

    I am concerned that you have automatically assumed that the OP has sold a fake pair..even then surely making a fraudulent statement hardly seems like a piece of good advice :confused:

  • I meant a KNOWN genuine pair as the OP said she wasn't entirely sure they were genuine. It does seem unfair to be sent a bill for what has been described as a good faith sale

    Fair or unfair, how is this an HONEST course of action?
