Item not Received - Seller not Eligible for Paypal Protection

Hi all,

I need some help there. Basically I bought several items from a US seller on Ebay. I paid using my Credit Card via Paypal. I still haven't received the item although it was posted on the 23rd of September. So I'm giving it a few more days until I start to take any action.

The buyer is not eligible for Paypal Protection and has 100% rating though. I can't claim my money back from Ebay either because Ebay charges £15 for each item and they are worth less than that each.

My question is simple:

If the item does not turn up and the seller does not want to give me a refund, can I claim my money back through my Credit Card provider ?


I think we have some consumer rights when buying stuff online but I'm not sure what the law is.

    i was under the impression that this credit card protection thing only kicks in if you spend more that 100pounds.

    If the seller had any brains they would have sent the items through some insured trackable method. If so, and your items don't turn up, in theory they should be able to give you at least a partial refund..and then claim from the insurance.

    If the goods dont turn up you can claim your money back via paypal for none delivery of goods.
    You need to click on the actual paypal transaction
    at the bottom is Resolution cetre.
    click that and follow the instructions.




    How did he send the goods airmail or surface .

    Thanks for the quick replies. I asked the seller to send the stuff non recorded as I was on holidays and the package would have returned to him. Also customs sometimes look into recorded delivery packages and charge you for it on reception. (I've had a problem like that in the past). Can't I just call my bank and tell them I bought stuff online and it never arrived ? I think I read somewhere in here that you have some rights to get a refund during the cooling off period ?

    Customs can look into any package they like...not just recorded ones. That's why labels are needed on the outside of the package saying what is inside and the value.

    Yeah it does ECo.

    Just follow the instructions in the resolution centre.

    Paypal nearly if not always come down on the side of the buyer if the seller cant prove delivery

    Yep, in my case the price tag on the package triggered customs to look into it. Now I ask sellers to only declare small amounts, even though I bought the items more.
