Where Do We Stand??

Hello Chaps,
We renewed our tenancy agreement with our letting agents in Feb 08 & They agreed & wrote in to the new agreement that the bathroom flooring would be replaced in April 08.
- Having not heard anything I started to chase this up last mth, they finally came to measure up last wk, & have decided that they cant put a new Bathroom carpet in without moving the whole bathroom suite out!!! -
They have said they are not going to do it & we can either move out now, or they will repalce the flooring when we move out.... Where do we stand now?

Not at all! I think the situation really is that we have decorated what was a shabby flat, & the landlord relises now it is in better order he can rent it out for more than we are currently paying.

nonsense - of course you can fit carpet around a bath ! taking the mickey !! if you want to stay and like the place, why not replace the flooring yourself and deduct the cost from the rent0

I appreciate I am going off track a bit but anyone who wants a carpet in the bathroom needs their head examined. Go Amtico. I will say that Clutton's suggestion is questionable.

um, B&Q do presized bathroom carpets from about £19.95.
This really isn't any issue with making a fuss over.
Unless your bathroom is the qize of the queens, £20 will solve the carpet problem as you can just tell the EA to get lost and leave you alone.Bankruptcy isn't the worst that can happen to you. The worst that can happen is your forced to live the rest of your life in abject poverty trying to repay the debts.0 -
You don't say how long your renewed tenancy agreement is for?
Floor coverings provided by a LL should be free of defects and not some kind of festering health hazard, and if your LL belongs to any accreditation scheme locally he's also got to meet the scheme's standards on floor coverings etc.
Yes, they should replace it, especially if they mention doing so in the agreement, but as SquatNow says sometimes you have to balance the actual cost involved if you sort a solution yourself as opposed to the value you place on your time if you are to chase it up. Maybe suggest to the LL that you get the carpet/vinyl bought & fitted & deduct the cost from the rent? Go on about saving him the hassle but only do it this way if you have written agreement - don't just withhold rent. If the current flooring is really bad & this isn't a possibility then I'd take photos ( with date evidence) , and write to the LL saying that as they are reneging on their agreement, for hygiene reasons you are lifting his flooring and you would like him to store it until the end of your tenancy, & you will get your own carpet/vinyl and take it up when you leave unless he reimburses you. Keep a copy of the letter so he doesn't claim that he did replace it when it's time to return your deposit.
And if you are signed up for a Fixed Term he can't just ask you to leave because you wanted a new floor covering!0 -

but instead of relacing the floor i would try to get something over it ... that i can remove when I leave
not always possible (because of door etc) but worth a look0
