faulty xbox

I bought the kids an xbox360 from a local branch of a dvd rental chain on the 3.11.07, it has developed the red circle of death. I took it back to the store and the girl on duty told me to contact Microsoft directly and they would arrange repair/replacement.
Am i correct in thinking that the retailer is obliged to deal with the problem not me?
As the Xbox is outside the normal 6 month period by 1 month as covered under "Goods which fail in the first six months are automatically presumed to have been faulty when you got them" but has a common fault, that microsoft extended their warranty to cover, can i insist on a replacement?

    Well as it's a recognised fault then despite the onus being on you to prove the fault (as you've had it over 6 months) one of the options open to them is to repair the item, in order to do this they'll be sending it to Microsoft anyway so really if Microsoft offer an almost no questions asked repair/replacement policy it may simply be easier to send it direct. It will probably save more time also. As much as I like the SOGA it's easy to forget that if a company refuses to comply with it you'll only get your problem sorted by taking them to court. When there's a ready made solution sitting in front of you why not take it?

    My xbox 360 got the red ring of death last year, it was over 6 months old. I just rang microsoft and it was dealt with, with no problems. They sent the courier (ups) to collect it and then deliver it back again. If they cant fix it they will replace it. Mine was replaced, I checked and it had a newer production date on the back to the one I sent back.

    I would say this is the best way to get it sorted. As Bamber said the shop would only send it away too. It takes bout 3 weeks though from sending it away to getting it back so the kids will have to do without it for a while.

    When you get it back either replaced or fixed, it is guaranteed for another 3 years for the red ring problem, Its a commen fault thats why they extended their warranty to 3 years as people complained :)

    Oh and another thing, it doesnt cost you anything, courier etc is all free

    I was hoping to avoid the 2-3 week waiting for it to be returned in the hope they'd change it in store, but a quick search on the web suggests it might be quicker than that now so sounds like the easiest way to go is to deal direct with microsoft.

    What a terrible state of affairs. You are a consumer, the sale of goods act protects this nonsense. Go into the store and demand a replacement there and then. Speak to the manager firmly. Tell them you want the cost of the second travel reimbursed and money for taking the time off too. Demand your compensation and repair.

    Write back with the results.

    the ring of death was a problem with the firrst lot of x boxes that microsoft first shipped out which is strange since you brought this one at the end of 07.

    anyways return it to microsoft as has been suggested and get a replacement - ask them to send you a free game for the troupbe of not having a xbox for 3 weeks or so - no harm in trying :D

    I have to say, I'm leaning toward dangeroussports view here..

    Your console's developed an easily identifiable fault that the retailer really ought to deal with. It's gotta be worth going back and asking again / asking to see the manager. Make it clear that you're aware of your rights and that as the retailer they are responsible for replacing or repairing the unit. If you just keep talking long enough, the manager may well get bored and just give you another one.

    Might save a couple of weeks, anyway. Only half hour of your time to lose.

  • Just be warned. It has been widely reported that xbox's sent back to microsoft are checked for about 30 seconds and if no ring of death is found they put them on an "OK" pile. Then when you send yours in, you get someone elses garbage as your replacement. I've sent back 5 of these things and got a different serial number every time i got one back. Eventually i got fed up and they sent me a brand new one, complete with HDMI (think thats the thing that plugs into my tv) socket (thats how i knew it was new) Also got some new bits to go with it and i didn't even ask. I just pointed out matter of factly that they were returning a different box every time instead of repairing it. I was willing to provide proof and offered it but they didn't even argue.
    Just make sure you make a note of all serial numbers.
