GAME - returning something

We purchased Rock Band for our kids on 23 May from our local Game store at a ridiculous cost. We kind of annoyed them by complaining the next day about the price they were charging - £25 more than the other stores.

Well the problem I have now is that the guitar for the game is not working properly. We contacted the Game store that we got it from who fobbed us off by saying we had to contact EA Games (the maker). As far as I am concerned I purchased the game and equipment from Game not EA Games. All we want is for them to replace the guitar not give us all our money back.

Hoping I have posted this in the correct place. Any help/advice would be appreciated.

    Your contract is with Game not te manufacturer so you are correct in returning it to Game. If they refuse to help you, quote the 'Sale of Goods act 1979' where your items should be in good working and fit for purpose.

    I will be contacting them again tomorrow because it was my hubby that phoned them. As far as I was concerned we bought it from them not from EA Games. Like I said think we annoyed them when we tried to get them to honour their 'price promise' because they were charging more than the other stores in our town.

  • I was always under the impression that if something breaks more than 2 weeks after being bought, you go to the person who made the product.

    The reason it's such a big deal is because you're wrong.

    The Sale of Goods Act 1979 makes the retailer responsible for up to 6 years (thanks to the Limitation Act). Within 6 months it is the responsibility of the retailer to prove that the product was not faulty at the time of purchase. After 6 months it is up to the purchaser to prove that it was faulty.

    It is the retailer's responsibility to ensure that all goods it sells to consumers are as described, fit for purpose, and of reasonable quality. The manufacturer, strangely, is under no such legal obligation unless it warrants the goods so.

    Your best course of action here is to send this letter, recorded delivery, to GAME's Head Office. Give them 14 days to respond. If it was me, I'd demand a refund and buy the guitar somewhere else given the deplorable way they've treated you, but if you'd rather a replacement that's up to you. If they don't respond, send this letter, recorded delivery, again to GAME's Head Office. If you don't get a satisfactory response within the next 7 days, take them to the cleaners. They deserve it.
