OfCOM & Broadband Minimum Contracts

According to AOL customer retentions, if the monthly fee for broadband falls below £10 per month, OfCOM rules state that any contract is "unenforceable".
I was uneasy about signing up to a 12 month contract (due to intermittent connection probs) which I presume is why he said we would be able to get out of it, without penalty, by quoting OfCOM regulations.
I've been reading through OfCOM's publications but couldn't find anything, so called them. They had no idea so I wondered whether anyone here has heard of this?

Total and utter rot.
There is no such thing in any of the regulations, so AOL have been telling porkies.

Ofcom cannot dictate British Law regarding what a contract is.
Use some common sense!0
