Two letters demanding money

I have had two letters this morning from 1st credit demanding debts from an old bank account with HSBC, They amount to over £10000.

They are addressed to my maiden name and since I have been married 9 years are quite old debts. I know they have been trying to find me for some time as they have been sending letters to my Mums address (she never game them my address) So now they have found me and its for so much they are not about to let it drop and yet I am not in the position to offer them 50p let alone 10k.

I permanently feel like I am fighting a losing battle. I have enough problems trying to stay of bankruptcy as it is, sorry just feeling rubbish right now. :(

Any advice please

    Do you know when the last payment made to the account would have been? If more than 6 years ago, the debt is probably statute barred and unenforcable.
    After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

    The last payment I made was probably between 9-10 years ago but they told my mother in a letter that they had a ccj and that this was still enforcable?

    Not if she didn't move her address and has been in hiding....

    HI , If they do in fact have a CCJ , you need to request proof . That is the first step . But never ring them , conduct everything by letter only . Do not sign any letters , and only refer to the " alledged debt".

    You could as a first step reply to the letter , I presume they are using maidan. by just referring to the ref no on their letter saying there is no one at your address with that name . Put no other details .

    A debt becomes statute barred after 6 years from the date of last payment or written acknowledgement of the debt. If there is a CCJ on this debt, this can be enforced for a further 6 years, after which they would need to petition the courts again to be allowed to enforce this debt.

    Don't make ANY payments to this company in acknowledgement of any debt orany other reason.

    Could be they will take that £10 as a payment to the account , thus invalidating the time barr . Try my advice , second bit.

    For proof of a CCJ you could contact the courts they claim to have obtained the CCJ through... they should be able to confirm or not if a CCJ has been issued.
