If a banks sends letters asking for repayment, but you just throw them away - for 6 years, you could claim that the debt was statute barred but if the bank took it to court and could show that they had regularly attempted to contact you then the judge could find in their favour.

After 9 years i doubt that the debt is still with the original creditor. A DCA will have bought it for a few pence in the pound and will be hoping that they can find the individual in question who won't know what "Statute barred" means.

If you don't respond to their letters, usually it's because you no longer live at that address. If a banks has sent letters to that address it would show on their systems which may be accepted as evidence. A few lost letters, fair enough, but years worth?

By that time though the bank has usually sold on the debt anyway. Just wanting to highlight that just because a debt has had no payments for 6 years does not mean that the debt is automatically statute barred. Judges have been known to dismiss the claims if they feel there has been fraud involved. You can't go to a restaurant, eat your meal and say that you're not going to pay for it. There are laws protecting the banks so that this doesn't happen.
