Crapquest vs Me
May
Hi everyone
I posted a thread not so long ago about crapquest wanting to take me to court for non payment of an old cc debt. I acknowledged it but disputed the amount. I filled in my allocation questionnaire received from the court and stated my dispute with crapquest. Upon advice from you lovely people, i requested statements and a copy of the cca from crapquest. I have received details from the court advising of a month's stay of settlement to settle this matter. I haven't heard anything from crapquest and sent my postal order and letter to them on the 29th May.
Can anyone advise of what i should now be doing? I did advise the the court that i am willing to use their mediation service but i have received no further information about this either.

Did you receive statements from CQ ? As part of the court procedure you are entailed to copies of all evidence the other party is going to rely on . Did you atten the hearing ? More details please .0

Did you send the letter by recorded delivery? So you have proof they received the request?
Did you just ask for the cca or also a statement of account? After falling off the gambling wagon (twice): £33,600 (24,000+ 9,600) - Original CC Debt: £7,885.91

hi there,
Yes the letter was sent by recorded delivery of which it has been received.
I haven't had the hearing yet. I advised the court on my allocation questionnaire that i requested this information from cap quest. And so far i have heard nothing from capquest.
1. Received form from northampton. Filled it in advising that i acknowleged debt but disputed amount and was writing to capquest to come to agreement but disputed amount - cpoied court in with letter.
2. Wrote letter to capquest advising was willing to come to an agreement nut disputed amount.
3. Received allocation questionnaire from local court - filled in and returned
4.Received copy of capquest's allocation questionnaire
5. Requested copies of statements and cca from capquest
5. Received letter from court advising a month's stay of settlement
6 - Not heard anything from cap quest since0 -
ok thats good . I would prepare as best you can theres are loads of good tips about . You must go along to the court , there is a chance CQ don,t turn up . Writeout a list of question etc and also prepare a claim for costs to claim from CQ if they fail to appear . I would guess CQ are having trouble gettin full list of monthly statements . You should be entitled to the last six years , if and when they do arrive check they are ALL there . It may be that you have penalty charges you can claim back . ALSO no true signed CCA no enforceable debt ! good luck0

thanks for this.
The last letter received from the court states that both parties should come to an amicable agreement by the 21st July. I take it then if i haven't heard, wait for a court hearing?0 -

I would write again to DCA ( recorded delivery ) reminding them of your request , this willshow court you are trying to resolve the issue .0

Thanks for the help guys.
Still haven't heard from Crapquest. Phoned a legal line today. They said that i should write to capquest asking them to helo resolve this before 5th July. Also to phone the local court to find out about the mediation service.
I still haven't heard from crapquest and i won't ring them as i then have no evidence of the phone call. I sent a letter recorded delivery today asking for them to cooperate in coming to an amicable agreement within the timescale given.
Any other advice? I'm quite nervous about the whole thing and don't want to attend court.0 -
Good evening everyone
An update of this situation now is, i requested the cca and statements on 27th May and never heard from capquest. I've since written two more letters to them. One on 27th June and another on 2nd July requesting cooperation in this matter.
Today i received copies of statements and the cca. And yes the balance is different to what they are asking for through the courts.
Please can anyone advise what i should do now. I thought they only had 12 days to return statements and in addition, i've had no other correspondance from them in attempting to resolve this amicably.
thanks0
