Help, my house is up for sale and I haven't been told

    Clearly anyone who wants to buy as a residential is going to want to view. There is no obligation for your Mum to conduct viewings and if one was requested the landlord would need to let your Mum know of the potential sale. My guess would be that the landlord is testing the water to see if he can sell it on as an investment property.

    Do ask what is happening.

    mums rang them today and the tennancy agreement ends 4th july but they have said thats it a roll over and that there is no need to worry and that they are looking at selling to get a new landlord, they have said they havn't had any interest yet though, i dunno what to think?

    It was cheaper than if she were to sell on the market obviosuly. They did it through rsg group.

    The best thing you can do is dig out ALL the paperwork about the agreement/sale so you can understand those terms. However, from what you've said, she's got no right to stay there any longer than any landlord (present or future) will want her to. And it's most likely her rent can be put up as/when any landlord wants to. So dig that agreement up and really paw through it for all the Terms and Conditions, so you are at least abreast of what the Agreement was and what was/was not allowed. Just in case the Agreement gives her more protection than others try to advise you of.

    Did she do this as a result of a national advert she saw?
    Or did somebody slip a letter in through the door?
    Can you name the company - even if you type most of it out with spaces between the letters and a couple of **s

    IF it sells. That's "IF" it sells.... then the new landlord might be as happy as Larry to leave things as they are.

    The WORST case scenario is: it sells quite quickly, new landlord gives your mum 2 months' notice to leave on the 4th of a month. e.g. if it were bought on, say, 3 August (after the paperwork's done) and the new landlord rushed round and gave notice, the leaving date would be 3rd October. But if it was bought on 5 August and the new LL rushed round with 2 months' notice, it wouldn't take effect until the next rent date (4 September) giving a leaving date of 3 November.

    So, that's how being asked to leave would calculate.

    Short of buying the house back, all your mum can do is wait and see.

    The market is very slow. Maybe there will be no buyer.

    Another WORST case scenario is: current owner couldn't afford it, defaults on his loan to buy it and he gets repossessed. In this case, your mum would, again get the 2 months' notice.

    However .... you never know, maybe another landlord will buy it and not try to increase the rent by a lot.

    It's difficult to second-guess what might happen because this is all about the personal choices and decisions of individual complete strangers and their motivation to sell/buy the property. AND ... what is actually in the Agreement signed at the time.

    Cards are on the table. Your Mum should work on the basis that she could be given 2 months notice for any of the reasons in PasturesNew's post and need to move.

    It may not happen, but better to be prepared.

    1. Check the tenancy agreement, though I bet it is an AST.
    2. Phone the quick-buy company and hassle them.
    3. Look around for a new home.
