Seriously stressed and upset, please help!

As from my post earlier today I found out I have a CCJ against me from 4 years ago.

I was not informed of this as I moved properties and the court papers were sent to my previous address. I only found out about it through my credit report.

I spoke to the debt collectors who obviously want their money.

I spoke to the court twice, who have said that i can appeal for the CCJ to be "set aside" due to the documents being sent to the wrong address. This involves a form and £75.

I have just been informed by several other people that this still wont get the CCJ off of my credit file. That for this to happen i need to contact the DCA and request a copy of the Court Forms and tell them that because they didnt send them to the correct address that its null and void and for them to inform the Courts to take the CCJ from my account. Then pay the balance of the debt in full so it is "settled".

I am completly confused, and very very stressed out. I just want to clear the CCJ off my file, clear the debt and be done with it.

I also got a phone call from another debt collector re: a different debt to EDF energy for £390.

Im starting to cry and i cant bare this, how could i of let it get so bad.

    Hi

    Yes the Courts told me it was for Singlepoint 4 U which has now been sold to Vodafone (a mobile phone bill).

    OK, was you paying this debt, PRIOR to the CCJ being granted, if so, why did they apply for a CCJ?

    I dont think i was. To be honest the first I have heard about this is today.

    All the documents etc. were sent to an address of 4 years ago. I had to contact 3 debt collection agencies before i found the one who actually owns the debt.

    I just dont know what to do. I need thsi CCJ off my record so i can get a shared ownership mortgage next year.

    I am/we are familiar with the Office of Fair Trading Debt Collection Guidance which states that it unfair to send demands for payment to an individual when it is uncertain that they are the debtor in question.

    I/we would also point out that the OFT say under the Guidance that it is unfair to pursue third parties for payment when they are not liable.

    In not ceasing collection activity whilst investigating a reasonably queried or disputed debt you are using deceptive/and or unfair methods.

    Furthermore ignoring and/or disregarding claims that debts have been settled or are disputed and continuing to make unjustified demands for payment amounts to physical/psychological harassment.

    I/we would ask that unless you can provide evidence as to my liability for the debt in question I will issue a formal complaint with the regulatory bodies, as it has come to my attention a CCJ has been issued againts me.

    I/we await your written confirmation on the points I have raised above.

    Otherwise I will have no option but to make a complaint to the trading standards department and consider informing the OFT of your actions.
