Help does anybody know the answer to this ? I got into problems with paying a loan to Northern Rock and despite my best efforts they passed the debt to some scary people called Eversheds who threatened me and made my life hell. Then a letter arrived saying they would accept £100 in full and final settlement of a £19000 pound debt.I have paid the money and written to them saying this is in full and final settlement. Is this legaly binding ? I am petrified of what they may do next. The citizens advice seem to think it is binding and so do the consumer counciling service .HELP:eek:

If they put it in writing, then you put it in writing, if anything happens you have proof you did what was asked. Did their letter explicitly say - in full and final settlement? This year I'm getting organised once and for all, and going to buy a house with my wonderful other half. And that' s final!
Current Pay Off Target : £1500 :mad:0 -
you seem to have asked the people that should know. Good luck.0

Yep if they put it in writing and used the words "full and final" then whether it's a typo or not that's it for that debt (I assume they stated on the letter what debt it was relating to?)
Keep a hold of that letter though! DO NOT LOOSE IT! And make sure you keep a copy of the statement showing the cheque clearing your account and if you can then send them a letter in a few days (recorded) asking that they update your credit files etc showing that the debt has been paid in full and is marked as "satisfied" on your credit reports
If they do that then you shouldn't hear any more from them. Otherwise you might have to prod them along a little

I hope this works out for you!!! How excellent to get one over on the debt collection agencies!!!!!!
Well done!!!!!!!
(i had eversheds once for an Egg loan, now cleared thankfully, they weren't nice but not overbearing really. ) sorry you had bad experience with them, but hey what a way to get one over on them!!!!!!!!!
some poor administrator is going to get her bumps felt for that error!
For £19,000 debt i suspect they missed 2 zeros... £10,000 might have been about right. I asked Evershed for F&F and never got less than 1/4 off.... so to get £19,000 for £100 is mind boggling!!!!!!!!
Take this as a very fortuitous thing and use this £18,900 saving as a great opportunity to knuckle down and sort out any other debts. you've been handed a mega lifeline if this all goes in your favour.... and i suspect it will.I'm just a seething mass of contradictions....(it's part of my charm!)0 -
Well first thing is did you ever receive a notice of assignment stating the account had been sold to this DCA ? I do not believe NR would sell a debt to a DCA . Its more than likely the DCA were acting for them . I do hope I am wrong ! But I would very much doubt that this is the end of the matter .
You could ring NR with the account number , if they say they are no longer dealing with it , ask if they sold the debt .And if they did ask for conformation. good luck0 -
This is clearly a typing error . If you receive a electric bill for £194500 , you would rightly assume it is a typing error . If this DCA were acting on behalf of NR I would say they will be in contact shortly . One footnote to this is the Grovenment bailled out NR using our money, to the tune of £3000 per tax payer. I understand your problem but not sure anyone would call this result fair .0

While it is most likely an error I'd be tempted to stand my ground they made a legal offer which you accepted tough luck to them.Barclaycard 3800
