Hi again yasmeen ... thanks for clarifying the position. Now we can move on (I hope) to helping you - I have seen posts from other members who I am guessing have day to day involvement with Companies like Angel Assistance - so I am hoping if they see your posts - they may also contribute to this, where I can't, ok.

First, lets clarify that Angel Assistance is a subsidiary of HelpHire - so that might help because we are at the end of the day dealing with "one" source, not two independent Companies - I say that if we have to seriously complain either to them or to their regulator.

I have copied in below an extract from the Angel Assistance website:

Angel can help if you have been involved in an accident, anywhere in the UK or Europe. We can provide you with legal expertise and legal expenses, of up to £50,000, making sure you are professionally represented so you don’t lose out.

Accidents do happen, and apart from being traumatic, they can also be expensive and time consuming as you fight for the compensation you deserve. Solicitors and experts can be costly, but essential to your case. Angel will not only provide you with the legal experts you need but will also cover the costs, taking the financial outlay, risk and worry away from you.

Where possible, Angel will negotiate a case settlement for you, but if proceedings are unavoidable Angel will support your claim through the courts of the relevant country.

Helphire can also help if your vehicle is written-off by providing you with replacement transport until you receive a cheque for the pre-accident value of your vehicle.

Angel Assistance Limited is authorised and regulated by the Financial Services Authority (FSA).

The link to HelpHire site is here:

I have outlined 3 bits in red - that is what Angel say is to happen - and we need to start there - because in your case it appears what they say they will do is not happening - not least because they are causing you worry not relieving you of it.

1: In my earlier posts - I suggested there may be a problem with the other party's Insurance - that is a total guess on my part - but I think that has to be the main question you ask Angel Assistance - do they think the delay is caused by that, and if not what exactly do they think is the cause?

2: You will see that they try to negotiate a settlement - but if they fail, then they will take legal action. Taking legal action obviously costs them money - so they will want to avoid that - and that will be why (IN PART) they are saying what they are saying - but it doesn't explain why there is a delay - thus the first question. But, when you contact them - please ask them to confirm that the next step in July is that they will be taking this matter to court - let's see if we can tie them down to that and preferably get them to do so in writing.

3: You mentioned that you had a replacement car - then it was taken away. you will see from the paragraph above - that is not what they say will happen - they say you get that replacement car - until you get the settlement cheque. So you need to ask them why that didn't happen, and that they now honour their promise which is in published form and in the public domain.

I suspect (but again it is a total guess) that they may have sensed a problem with the other party's insurance - and saw their costs escalate - but I don't know that, and that is the risk THEY take in offering to provide you with cover, it should not mean they break their promise. You haven't got a settlement cheque, so their promise is you should STILL have a replacement car - ask them to fulfil their promise or explain fully why not, ok?

Now this has been a long post, (sorry - it's the only way I can do it), some of it is guesswork, some of it is meant to help, ok. If you again contact Angel and ask them to clarify the position, and then let us know how they respond/reply - maybe then we can see what may be the next steps.

One of them will be to start to build a picture of ALL your losses that you can claim - and that will not just be the loss of your car, but let's see how you get on first, ok?

PS: I don't think you should contact the other party's Insurer (not yet anyway) - in case it affects the way Angel help you - let's not give them any excuse to argue on. Just my opinion, ok.

Hi MF I just got off the phone from angel assistance:mad::mad:

I spoke to a lady from the legal department of Angel Assistance.I asked her some of the questions you put forward to me.

Q)Why was the courtesy car taken off me before I got paid for my car?

A)Help Hire provide a courtesy car for 52 days from accident date and if there is a liability issue then they can take the courtesy car back.

Q)Why is it taking too long to sort out my claim?

A)I have called AIG (3rd parties insurer) to find out and I was told that the manager was not in the office and I will call them back later to speak to him and find out what is happening with your claim and I will call you back later today to inform you of any changes.

Q)I was told by Angel Assistance in the first instance that the AIG have until 3 months after the accident date to make a comment on liability. When 3 months passed,I was told it will take another month(13/06/08).Earlier this month I was told AIG have a deadline of 13/07/08 to make comment on liability if not then Angel Assistance will take them to court. My question is that I want you to confirm that if by the 13/07/08 AIG has not made in comments in relation to liability, will you be taking legal action and taking AIG to court?

A)Hmm! Hmm! I will need to speak to my supervisor and when I have spoken to him I will call you back later and inform you.

I want thank MF for taking time out to read my post and I want to say im glad I came to this site as people here seem to be helping me more then my LEGAL TEAM!

Hi yasmeen ... I guess at times in all of our lives, we need help, it's been true of me in the past and will be again perhaps, and will be true of most people on this forum - so happy to help you, ok!

What I am about to say is partly "tactics" - it may work, it may not, but I want to see (first) if we can get you a courtesy car again. Now, if it doesn't work, I still think it may help overall to get things moving for you - what we need to do is get your file seen as important - not just another file as far as Angel are concerned, ok, which is where I think you are at present.

So ... when you speak to Angel again - despite what they have said about the 52 days - read out to them what it says on their website, this bit:

Helphire can also help if your vehicle is written-off by providing you with replacement transport until you receive a cheque for the pre-accident value of your vehicle.

Point out to them that you are so disappointed that you are considering asking whether that statement, irrespective of what they are now telling you, is in breach of the Advertising Standards, and also in breach of the rules of their Regulatory Authority ... which in both cases (again I am guessing) may be true.

I hope that may cause them to think about giving you a courtesy car again - just to stop you doing anything further, ok. As I say it may NOT work, but it's worth trying imho.

Also ask them (again if need be) - why they think it is taking so long - do they think there is a problem with the other party's insurance - that could be important, ok.

Press for the position on legal action again - and ask for any answer in writing - insist on that imho!

Now ... the point I made earlier, about what you can claim for, ok. When you hear from them ask them to tell you what they are claiming for? Is it just the value of the car - because there are other items you can include, like travel costs while you have not had a replacement car, maybe also pain and suffering, and anxiety. What I want to avoid is everyone just focusing on the value of the car, getting it settled to get rid of you - when the claim should be for potentially more, ok?

Let's see how it goes ... good luck!
